ARGUMENT(S) | |
The USPTO has refused Applicant’s application on the grounds that the drawing does not match the mark on the labels submitted as Applicant’s specimen of use. Specifically, the applied-for mark is A-TRAIN, and the labels submitted as specimens of use depict A-TRAIN PR. Applicant respectfully notes that the PR following A-TRAIN on the submitted labels is not part of the mark and is merely used as a model or grade designation to identify the particular chemical variation within Applicant’s A-TRAIN product line. TMEP 1202.16(c)(iv). This practice of adding a set of numbers or letters following a mark is common practice in the chemical industry to denote the chemical variations within a product line. The attached declaration of Edward Boss, president of Applicant, swears to this under oath. Additionally, the trademark record for a third party’s similar concrete additive product – MASTERGLENIUM (US Registration No. 4386070) – illustrates the use of a model or grade designation following the mark. A copy of the declaration of use, filed June 18, 2019, is attached and includes a product label marked MASTERGLENIUM 7620, which was readily accepted by the USPTO without objection. The declaration of Edward Boss also includes evidence to illustrate use of the proposed mark with other similar notations in the form of website screenshots and data sheets that accompany the A-TRAIN product when it is distributed to customers, e.g., A-Train PR, A-Train FF, A-Train VR. TMEP 1202.16(c)(iv). Finally, the attached declaration provides additional information about the specimens as requested by the USPTO in the Office Action. In light of this additional information to clarify that Applicant’s specimens do in fact match the mark in the drawing and the labels are in use on bulk chemical containers in US commerce, Applicant respectfully requests that the USPTO withdraw its refusal and place the application in line for publication. |
