DATABASE SEARCH:  The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no similar registered marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).  However, marks in prior-filed pending applications may present a bar to registration of applicant’s mark.

 

Because marks in prior-filed pending applications may present a bar to registration of applicant’s mark, this application will be immediately suspended until the earlier-filed application is either registered or abandoned.  37 C.F.R. §2.83(c).

 

APPLICATION HAS BEEN AMENDED:  In accordance with the authorization granted by Jamie Fugitt on April 17, 2019, the trademark examining attorney has amended the application as indicated below.  Please advise the undersigned immediately of any objections.  Otherwise, no response is necessary.  TMEP §707.  Any amendments to the identification of goods and/or services may clarify or limit the goods and/or services, but may not add to or broaden the scope of the goods and/or services.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.

 

IDENTIFICATION:

The identification of goods and services is amended to delete Class 25 and to read as follows:

 

Class 9             Downloadable electronic publications in the nature of electronic books, periodicals, digital magazines, newsletters, articles, and written interviews in the field of dance; Downloadable webcasts, podcasts, digital audio files, and video recordings, and downloadable multimedia file containing audio and video interviews, all in the field of dance

 

Class 16           Printed matter, namely, paper signs, books, manuals, curricula, newsletters, informational cards and brochures in the field of dance; Printed materials, namely, curricula in the field of dance; Printed materials, namely, written articles in the field of dance; Printed publications, namely, brochures, booklets, and teaching materials in the field of dance

 

Class 41           Education services, namely, providing mentoring, tutoring, classes, seminars and workshops in the field of dance; Educational services, namely, conducting programs in the field of dance; Educational services, namely, developing curriculum for others in the field of dance; Entertainment services, namely, providing podcasts in the field of dance; Entertainment services, namely, providing webcasts in the field of dance; Entertainment and educational services, namely, the presentation of seminars, workshops and panel discussions, and ongoing television and radio shows all in the field of dance; Education services, namely, providing classes and instruction in the field of dance; Educational and entertainment services, namely, providing motivational speaking services in the field of dance; Entertainment in the nature of competitions in the field of dance; Entertainment services, namely, arranging and conducting of competitions in the field of dance Non-downloadable electronic publications in the nature of electronic books, periodicals, digital magazines, newsletters, articles, written interviews in the field of dance; On-line journals, namely, blogs featuring dance; Providing online non-downloadable digital visual and audio recordings featuring dance; Organizing, arranging, and conducting dance events; Providing information, news and commentary in the field of current events relating to dance
