TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.
ISSUE/MAILING DATE: 4/2/2019
The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issues below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
SEARCH OF OFFICE’S DATABASE OF MARKS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
SUMMARY OF ISSUES:
I. NEW DRAWING REQUIRED – TM SYMBOL IN DRAWING
Applicant must submit a new drawing with the TM symbol deleted from the drawing of the mark. The TM symbol is not part of the mark and is not registrable. See 37 C.F.R. §2.72; TMEP §807.14(a). Although applicant must delete this matter, applicant may not make any other changes or amendments that would materially alter the drawing of the mark. See 37 C.F.R. §2.72; TMEP §§807.14 et seq. For more information about deleting matter from the drawing, see the Drawing webpage.
II. AMENDMENT REQUIRED – DESDCRIPTION OF THE MARK
The following description is suggested, if accurate: The mark consists of an uppercase stylized letter "A" within a square box, with the horizontal line segment of the letter "A" beginning at the bottom of its left vertical line segment and angled to cross through, and extend slightly past, its right vertical line segment at approximately one third up from the bottom of its right vertical line segment. Underneath the square box are the uppercase stylized letters "ANZZI" with the letter "A" therein having the same features as the "A" within the square box.
III. INFORMATION REQUIRED – SIGNIFICANCE OF THE MARK
To permit proper examination of the application, applicant must provide the following information:
(1) Explain whether the wording in the mark “ANZZI” has any meaning or significance in the industry in which the goods are manufactured/provided, any meaning or significance as applied to applicant’s goods, or if such wording is a term of art within applicant’s industry.
(2) Explain whether this wording identifies a geographic place or has any meaning in a foreign language.
(3) Submit an English translation of any and all foreign wording in a mark. If the wording does not have meaning in a foreign language, applicant should so specify.
The format for an English translation: “The English translation of “ANZZI” is “{specify meaning in English}”.
The format for when there is no English: “The wording “ANZZI” has no meaning in a foreign language.
(4) Respond to the following questions:
-Is ANZZI the surname of anyone connected with applicant’s business, and if so, who? Please specify the name and title of the person(s).
See 37 C.F.R. §§2.32(a)(9)-(a)(10), 2.61(b); TMEP §§809-809.03, 814.
Failure to comply with a request for information is grounds for refusing registration. In re Harley, 119 USPQ2d 1755, 1757-58 (TTAB 2016); TMEP §814.
