Subject: USPTO Trademark Application Nos. 88266726, 88266745, 88266751
Dear Nicole:
Thank you for your responses filed for application nos. 88266726, 88266745, and 88266751.
We need to circle back on the identification in Class 39. Apologies for the oversight, but “Maritime and marine consultancy, namely, consulting with respect to the management and operation of port facilities and terminals” encompasses business consulting in Class 35 and consulting with response to cargo handling in class 39. Applicant may either transfer the identification to Class 35, or amend the identification to render it definite in class 39.
The following is suggested, if accurate:
Class 35:
Business management and operation of port facilities providing large container, specialized container, bulk, dry, break-bulk, liquid and general cargo handling services; agency services, namely, import and export agency services for the goods of others; transportation logistics services, namely, arranging the transportation of goods for others; business operation of port facilities; business operation of port facilities for others; accounting services relating to vessel port calls; logistics management for vessels and cargo; data collection, processing, analysis and reporting relating to vessel port calls and cargoes for business purposes; preparation of business reports, namely, reports related to commodity cargos carried by vessels and exported and imported through port; maritime and marine consultancy, namely, consulting with respect to the business management and business operation of port facilities and terminals
Class 39:
Providing stevedoring services for cargo and passenger vessels; cargo supervision, namely the loading and unloading of cargo; maritime and marine consultancy, namely, consulting with respect to stevedoring services for cargo and passenger vessels and the loading and unloading of cargo
Please note, if this matter cannot be resolved with an examiner’s amendment by close of business this week, please inform me and I will send a follow up office action.
Regards,
/Rebecca Eubank/
