Subject: Trademark Applications for Serial Nos. 88295924 and 88266728
Dear Ms. Harrell,
I am the examining attorney at the U.S. Patent and Trademark Office assigned to U.S. Trademark Application Nos. 88295924 and 88266728 (the applications were recently re-assigned to me from the previous examiner).
While one of these applications, Serial No. 88295924, had been approved for publication on December 20, approval was withdrawn to address the issues below. I apologize for any inconvenience this may cause.
Identification of Services Requirement
We require an amended identification of the services because the wording “Coordination and arranging vessel-related services, namely, arranging, coordinating, and controlling transportation, loading and unloading, transfer and storage of goods” is indefinite. It is unclear whether the word “controlling” identifies a transportation-based service in Class 39 or a logistics service in Class 35. Further, the remaining wording in the above clause appears to be logistics services that are properly classified in Class 35.
Accordingly, the following amended Identification of Services is suggested, if accurate, with changes in bold:
“Vessel agency services, namely, providing business services to owners and charterers of vessels in the nature of coordinating port calls, arranging for the supply of goods, supplies and support services to vessels and crew, arranging for the provision of port-call related services for vessels and crew, and arranging for the supply, transport and handling of cargo; business services, namely, the coordination of and arranging for vessel-related services on behalf of seafaring clients while in port; vessel husbandry, namely, the coordination of and arranging for vessel-related services for others while in port; business administration services relating to vessel and cargo documentation; administrative services relating to customs clearance; purchasing and procurement services, namely, procuring of goods, supplies and support services on behalf of for vessel owners, charterers and cargo owners during port-calls for vessels, cargos and crew; business operation of port and terminal facilities for others; business services, namely, sourcing and buying services for others relating to vessels, cargo and crews during port-calls; import and export agency services; coordination and arranging vessel-related services, namely, arranging and coordinating transportation, loading and unloading, transfer and storage of goods ” in Class 35.
“Transportation of goods, loading and unloading of cargo, and storage of goods” in Class 39
Moreover, application 88266728 (HOST), has an identification that is identical to the identification in Serial No. 88295924. This identification therefore has the same issue.
Please let me know by close of business on Wednesday, Jan. 22 if you would approve of my amending the identifications as described for Trademark Applications for Serial Nos. 88295924 and 88266728. If you agree, I can make the changes for you via Examiner’s Amendments, and the applications may proceed toward registration. If I don’t hear from you, I will issue Office Actions in these two applications.
Best regards,
Christopher J Nodes
