I am the examining attorney assigned to the above-referenced application and there is an issue with the identification of services that must be resolved before I can move the application forward.
IDENTIFICATION OF GOODS AND/OR SERVICES
The wording “through education” at the end of the identification of serices is indefinite and must be clarified because it does not make clear whether applicant intends to provide services that “promote public awareness” or “educational services”. Please be advised that if applicant intends to provide educational services, the identification must be amended and reclassified in International Class 41. If however, applicant intends for its services to remain as “promote public awareness”, note that in this case it is only necessary in include the specific topic or subject matter of the services in the ID, and not the means by which applicant will render the services.
The following amended identification of services is suggested, if accurate, with changes in strike-through:
International Class 35: “Promoting public awareness of the cannabis and hemp movements
through education”
With your authorization to do so, I can add the amended identification via Examiner’s Amendment before moving the application along for publication review.
Please let me know by FRIDAY, JUNE 14, 2019 if you have any questions, need additional time, or would like to discuss further. If I have not heard from you by then, I’ll move forward with an Office Action formalizing the above issue.
