This application was approved for publication on April 10, 2019.  See 37 C.F.R. §2.80.  However, approval of the application has been withdrawn to address the issue(s) below.  See TMEP §706.01.  The trademark examining attorney apologizes for any inconvenience this may cause applicant.

 

IDENTIFICATION OF SERVICES – PARTICULAR WORDING TOO BROAD

 

The wording “Providing a website featuring information in the field of relocation and moving services; Relocation and moving consultation services; Relocation and moving services, namely, providing information such as move status updates, expenses, and policy information” in the identification of services for International Class 035 must be clarified because it is too broad and could include services in other international classes.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03. Information and consultation services are classified according to subject matter.

 

For example, information and consultation in the field of furniture moving and physical relocation services for trucks and trailers belonging to others is classified in International Class 039 (e.g., term IDs 039-27, 039-440, etc.) and information and consultation in the field of moving and relocation services, namely, planning and implementing moves of homes and offices is classified in International Class 035 (e.g, term IDs 035-1358, 035-1359, etc).  Moreover, the wording following "such as" is overbroad and indefinite because it does not identify a specific subject matter. It is not clear what is meant by "move status updates, expenses, and policy information" and this wording could include providing information regarding insurance policy information in IC 36. (see e.g., term ID 036-716). Therefore, the applicant must clarify the subject matter of its information and consultation services, and re-classify as appropriate. Additionally, the wording "such as" is an open-ended term and is not acceptable because it fails to identify specific services, and must be replaced with a definite term. See TMEP 1402.03(a).

 

Applicant must limit the identification to the one class paid for, or submit additional fees to prosecute this as a combined multiple class application.

 

The suggested identification below contains further guidance in bold.  Applicant may adopt any or all of the suggestions in bold so long as they are accurate. If applicant does not adopt a suggestion, then applicant must amend the identification so that it is as specific as the suggestions and language found in the U.S. Acceptable Identification of Goods and Services Manual.

 

Applicant may substitute the following wording, if accurate:

 

“Providing a website featuring information in the field of relocation and moving services, namely, planning and implementing moves of homes and offices; providing a website featuring information in the field of employee and personnel relocations; providing a website featuring information in the field of business relocations; providing a website featuring information in the field of office relocations; Employee relocation; Moving and relocation services, namely, planning and implementing moves of homes and offices; Moving and relocation services, namely, planning and implementing moves of homes for others; Moving and relocation services, namely, planning and project oversight of home moving for others; Personnel relocation; Relocation and moving consultation services for planning and implementing moves of homes and offices; business relocation consulting; Relocation and moving services, namely, providing information on planning and implementing moves of homes and offices, featuring related move status updates, expenses, and moving policy information.” 035

Where possible, the examining attorney has provided guidelines to assist the applicant in amending the existing identification of goods and services.

 

Applicant’s services may be clarified or limited, but may not be expanded beyond those originally itemized in the application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Applicant may clarify or limit the identification by inserting qualifying language or deleting items to result in a more specific identification; however, applicant may not substitute different services or add services not found or encompassed by those in the original application or as acceptably amended.  See TMEP §1402.06(a)-(b).  The scope of the services sets the outer limit for any changes to the identification and is generally determined by the ordinary meaning of the wording in the identification.  TMEP §§1402.06(b), 1402.07(a)-(b).  Any acceptable changes to the services will further limit scope, and once services are deleted, they are not permitted to be reinserted.  TMEP §1402.07(e).

 

REQUIREMENTS FOR COMBINED APPLICATION

 

The application references services based on use in commerce in more than one international class; therefore, applicant must satisfy all the requirements below for each international class:

 

(1)        List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.

 

(2)        Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule).  Specifically, the application identifies services based on use in commerce that are classified in at least three classes; however, applicant submitted a fee(s) sufficient for only one class.  Applicant must either (a) submit the filing fees for the classes not covered by the submitted fees or (b) restrict the application to the number of classes covered by the fees already paid.

 

(3)        Submit verified dates of first use of the mark anywhere and in commerce for each international class.  See more information about verified dates of use.

 

(4)        Submit a specimen for each international class.  The current specimen is acceptable for classes 035, 036, and 039.

 

(5)        Submit a verified statement that “The specimen was in use in commerce on or in connection with the goods and/or services listed in the application at least as early as the filing date of the application.  See more information about verification.

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE:  Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.  See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820.  TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services.  37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.  However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.
