Good afternoon, Mr. Friedman. Here is my counterproposal to the applicant’s proposed amended identification: Magnetic detection system for assisting medical and health care professionals in performing precision surgery, comprised of implantable magnetic seeds, a wand for locating the magnetic seeds, and computer hardware and software for use therewith, all of the foregoing sold as a unit; replacement parts of the implantable magnetic seeds and wands for locating the magnetic seeds; implantable magnetic seeds for assisting medical and health care professionals in performing precision surgery.
I cannot accept the language “and replacement parts for the foregoing” in your proposed amended identification because that would include replacement parts for computer hardware and software, which would be classified in Class 9. I cannot accept the wording “wands for locating magnetic seeds” as a separate item because the original identification of goods was limited to “implantable magnetic markers and magnetic detection system for use in surgery.” The only separate item is the “implantable magnetic markers,” which we are now calling “seeds.” The wand is not listed as a separate item.
Please let me know your thoughts on my counterproposal. Thanks.
