RESPONSE TO OFFICE ACTION
Highlands Harris LLC.(“Applicant”) respectfully submits the following amendment and remarks in response to the Office Action dated 3/19/2019
AMENDMENT Applicant submits the following amendment to the identification of services in International Class 003: Please allow the change from: DETERGENT FOR
to the following:
DETERGENT FOR ATTIRE AND INSTITUTIONAL USE
REMARKS
The Examining Attorney has initially refused registration of Applicant's mark under Section 2(d), 15 U.S.C. § 1052(d), on the ground of likelihood of confusion and prior-filed applications with Registration Nos. 4854740, 79239754 and 87699579. Application with Registration No. 79239754 has amended its application and does not seem to conflict with this Applicant's mark. Due to the more limiting change of the proposed amendment, Applicant respectfully requests reconsideration and withdrawal of the refusal. Conclusion For the foregoing reasons, Applicant submits that there is no likelihood of confusion between Applicant’s mark and the cited registrations. Accordingly, Applicant respectfully requests that the Examining Attorney withdraw her refusal of registration and allow the application to proceed to publication. |
