ARGUMENT(S) |
The Office Action advises that that the filing date of pending Serial No. 79241388 precedes applicant’s filing date, and that if the mark in the referenced
application registers, Applicant’s mark may be refused registration under Trademark Act Section 2(d) because of a likelihood of confusion.
Applicant submits that no confusion is likely. Action on Serial No. 79241388 is currently suspended based on, among other issues, the earlier effective
filing date of Ser. No. 87908201 (see Exhibit A). Applicant is owner of Ser. No. 87908201, which is now issued as Reg. No. 5810271 (see Exhibit
B).
The application at-issue consists of the word "BAYER”. Likewise, the goods and services now registered as Reg. No. 5810271 are substantially the same as the
goods and services in the application at-issue.
As the Office has already deemed Applicant’s own Reg. No. 5810271 as a potential bar to Serial No. 79241388, it would appear unreasonable to now suspend or
potentially bar refusal of Applicant’s BAYER wordmark for the substantially same goods and services over Serial No. 79241388.
In response to the Section 2(e)(4) refusal that the mark is primarily merely a surname, Applicant submits that the subject mark has become distinctive of the good
and services through the Applicant's substantially exclusive and continuous use of the mark in commerce that the U.S. Congress may lawfully regulate for at least the five years immediately before the
date of this statement.
Applicant also claims ownership of the cited marks in U.S. Registration Numbers 5299177 and 5299178.
Accordingly, Applicant submits that the application at-issue should be approved for publication in the Official Gazette.

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:
The Office Action advises that that the filing date of pending Serial No. 79241388 precedes applicant’s filing date, and that if the mark in the referenced
application registers, Applicant’s mark may be refused registration under Trademark Act Section 2(d) because of a likelihood of confusion.
Applicant submits that no confusion is likely. Action on Serial No. 79241388 is currently suspended based on, among other issues, the earlier effective
filing date of Ser. No. 87908201 (see Exhibit A). Applicant is owner of Ser. No. 87908201, which is now issued as Reg. No. 5810271 (see Exhibit
B).
The application at-issue consists of the word "BAYER”. Likewise, the goods and services now registered as Reg. No. 5810271 are substantially the same as the
goods and services in the application at-issue.
As the Office has already deemed Applicant’s own Reg. No. 5810271 as a potential bar to Serial No. 79241388, it would appear unreasonable to now suspend or
potentially bar refusal of Applicant’s BAYER wordmark for the substantially same goods and services over Serial No. 79241388.
In response to the Section 2(e)(4) refusal that the mark is primarily merely a surname, Applicant submits that the subject mark has become distinctive of the good
and services through the Applicant's substantially exclusive and continuous use of the mark in commerce that the U.S. Congress may lawfully regulate for at least the five years immediately before the
date of this statement.
Applicant also claims ownership of the cited marks in U.S. Registration Numbers 5299177 and 5299178.
Accordingly, Applicant submits that the application at-issue should be approved for publication in the Official Gazette.
