I am the examining attorney assigned to the above referenced application.  Before the application can be approved for publication the following issue needs to be resolved and I am hoping to do so by Examiner’s Amendment.  Specifically, the wording “nutritionally fortified beverages containing vitamins, minerals, fiber and dietary supplements; preparations for making nutritionally fortified beverages containing vitamins, minerals, fiber and dietary supplements” in class 5 requires further clarification.  The applicant must specify that these goods are for medical purposes to identify goods in class 5.  In addition, in class 16 the semicolon in the term “plastic materials for packaging; namely, bags” should be amended to a comma.  I propose amending the identification of goods to the following:

 

Class 5:                Pharmaceutical preparations for skin care, dental care, hair care; medicated skin care preparations; medicated hair care preparations; herbal mud packs for therapeutic skin care; medicated dental floss; pharmaceutical preparations for treating dandruff in the nature of dandruff shampoo; dermatological pharmaceutical preparations for topical weight control and body slimming purposes; dermatological pharmaceutical preparations for topical body refining and body shaping; medicines of Chinese origin for health care purposes, namely, weight reduction, skin care, hair care, hygiene purposes; herbal medicines for health care purposes, namely, weight reduction, skin care, hair care, hygiene purposes; dietetic foods, namely, sugar and tonic waters adapted for medical use; dietary supplements; vitamin and mineral supplements; dietary fiber as an ingredient in the manufacture of food supplements; soy protein for use as a nutritional ingredient in food supplements; medicinal alcohol; ginseng for medicinal use; food supplements containing ginseng; medicinal herb extracts in the nature of lingzhi; aloe vera gel for therapeutic purposes; food supplements for medicinal purposes; bee pollen for use as a dietary food supplement; nutritional supplements; nutritionally fortified beverages for medical purposes containing vitamins, minerals, fiber and dietary supplements; preparations for making nutritionally fortified beverages for medical purposes containing vitamins, minerals, fiber and dietary supplements; herbal supplements in tablet, capsule, pill, liquid, jelly, and powder form, and in ointment, cream or lotion form sold as a component of nutritional skin care products; nutritional supplements in tablet, capsule, pill, liquid, jelly, and powder form, and in ointment, cream, or lotion form sold as a component of nutritional skin care products; diet pills and capsules; stimulatory medications for use in weight control, slimming, and body refining and shaping programs in tablet, capsule, pill, liquid, jelly and powder form, and in ointment, cream or lotion form sold as a component of medicinal skin care preparations; medicated pre-moistened wipes for the skin; sanitary medicated hand wash; medicated sanitizing pre-moistened wipes, pads and towelettes; incontinence diapers

 

Class 16:              Paper, cardboard and goods made from these materials, namely, magazines, books, and pamphlets in the fields of or relating to health, make-up, beauty care, beauty treatment, pharmaceutical and medical services; posters, printed cards, circulars in the fields of health, beauty and fitness; catalogues on the subjects of health, beauty and fitness; calendars, price tags, price labels; printed matter, namely, greetings cards, leaflets and brochures on the subjects of health, beauty and fitness; book binding material; photographs; stationery; adhesives for stationery or household purposes; printed instructional and teaching materials in the fields of health, beauty and fitness; plastic materials for packaging, namely, bags, bubble packs, foils, films and sheets; paper carry bags, cardboard carry bags; plastic bags for shopping and packaging
