The Section 7(h) Request for Correction submitted on September 14, 2020 is not accepted for the reasons set forth below.

 

 

The registration is currently the subject of an inter partes proceeding before the Trademark Trial and Appeal Board (“Board”) and can only be amended (1) with the consent of the other party or parties and the approval of the Board, or (2) upon motion granted by the Board.  37 C.F.R. §2.133; see TBMP §§514.01-514.03.  Any fees submitted with the request will be refunded in due course.

 

The owner of the registration may file a motion to amend the registration with the Board, pursuant to Trademark Rule 2.133.  37 C.F.R. §2.133.  This motion must be served, and must comply with the requirements of 37 C.F.R. §2.133 and the requirements for a proposed amendment to a registration under Section 7(e) of the Trademark Act, including the required fee.  15 U.S.C. §1057(e); 37 C.F.R. §§2.119(a), 2.173.  Please contact the Board with any questions about filing such a motion.
