In response to the substantive refusal(s), please note the following:

The instant application was filed when prior registration no. 3978157 lapsed.  The USPTO approved the cited mark when prior registration no. 3978157 was active.  As such, the USPTO already made a determination that the instant mark and the cited mark can co-exist.  In fact, Applicant owns an approved and soon to be registered identical mark for goods -- see Application No. 88073432.  Therefore, Applicant respectfully requests that the instant application be treated consistently and similarly -- the citation should be withdrawn.
