INTRODUCTION

 

The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

SECTION 2(d) REFUSAL – LIKELIHOOD OF CONFUSION

 

Registration of the applied-for mark is refused because of a likelihood of confusion with the mark in U.S. Registration No. 4351977.  Trademark Act Section 2(d), 15 U.S.C. §1052(d); see TMEP §§1207.01 et seq.  See the attached registration.

 

Trademark Act Section 2(d) bars registration of an applied-for mark that is so similar to a registered mark that it is likely consumers would be confused, mistaken, or deceived as to the commercial source of the goods and/or services of the parties.  See 15 U.S.C. §1052(d).  Likelihood of confusion is determined on a case-by-case basis by applying the factors set forth in In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973) (called the “du Pont factors”).  In re i.am.symbolic, llc, 866 F.3d 1315, 1322, 123 USPQ2d 1744, 1747 (Fed. Cir. 2017).  Only those factors that are “relevant and of record” need be considered.  M2 Software, Inc. v. M2 Commc’ns, Inc., 450 F.3d 1378, 1382, 78 USPQ2d 1944, 1947 (Fed. Cir. 2006) (citing Shen Mfg. Co. v. Ritz Hotel Ltd., 393 F.3d 1238, 1241, 73 USPQ2d 1350, 1353 (Fed. Cir. 2004)); see In re Inn at St. John’s, LLC, 126 USPQ2d 1742, 1744 (TTAB 2018). 

 

Although not all du Pont factors may be relevant, there are generally two key considerations in any likelihood of confusion analysis:  (1) the similarities between the compared marks and (2) the relatedness of the compared goods and/or services.  See In re i.am.symbolic, llc, 866 F.3d at 1322, 123 USPQ2d at 1747 (quoting Herbko Int’l, Inc. v. Kappa Books, Inc., 308 F.3d 1156, 1164-65, 64 USPQ2d 1375, 1380 (Fed. Cir. 2002)); Federated Foods, Inc. v. Fort Howard Paper Co.,544 F.2d 1098, 1103, 192 USPQ 24, 29 (C.C.P.A. 1976) (“The fundamental inquiry mandated by [Section] 2(d) goes to the cumulative effect of differences in the essential characteristics of the goods [or services] and differences in the marks.”); TMEP §1207.01.

 

COMPARISON OF THE MARKS

 

Marks are compared in their entireties for similarities in appearance, sound, connotation, and commercial impression.  Stone Lion Capital Partners, LP v. Lion Capital LLP, 746 F.3d 1317, 1321, 110 USPQ2d 1157, 1160 (Fed. Cir. 2014) (quoting Palm Bay Imps., Inc. v. Veuve Clicquot Ponsardin Maison Fondee En 1772, 396 F.3d 1369, 1371, 73 USPQ2d 1689, 1691 (Fed. Cir. 2005)); TMEP §1207.01(b)-(b)(v).  “Similarity in any one of these elements may be sufficient to find the marks confusingly similar.”  In re Inn at St. John’s, LLC, 126 USPQ2d 1742, 1746 (TTAB 2018) (citing In re Davia, 110 USPQ2d 1810, 1812 (TTAB 2014)); TMEP §1207.01(b).

 

 

Applicant’s mark is “adidas” in a stylized font.

 

The mark in U.S. Registration No. 4351977 is “adidas” in a stylized font with a three bar design above and the term “TECHFIT” stylized below in a rectangle. 

 

U.S. Registration No. 4351977 is owned by adidas International Marketing B.V.  Applicant is identified in the application is adidas AG.  Thus, applicant and registrant are different owners.

 

Applicant’s mark and registrant’s mark are similar in appearance, sound, connotation, and meaning because both marks use the same identical stylization for the word “adidas”. 

 

When comparing marks, “[t]he proper test is not a side-by-side comparison of the marks, but instead whether the marks are sufficiently similar in terms of their commercial impression such that [consumers] who encounter the marks would be likely to assume a connection between the parties.”  Cai v. Diamond Hong, Inc., __ F.3d __, 127 USPQ2d 1797, 1801 (Fed. Cir. 2018) (quoting Coach Servs., Inc. v. Triumph Learning LLC, 668 F.3d 1356, 1368, 101 USPQ2d 1713, 1721 (Fed. Cir. 2012)); TMEP §1207.01(b).  The proper focus is on the recollection of the average purchaser, who retains a general rather than specific impression of trademarks.  In re Inn at St. John’s, LLC, 126 USPQ2d 1742, 1746 (TTAB 2018) (citing In re St. Helena Hosp., 774 F.3d 747, 750-51, 113 USPQ2d 1082, 1085 (Fed. Cir. 2014); Geigy Chem. Corp. v. Atlas Chem. Indus., Inc., 438 F.2d 1005, 1007, 169 USPQ 39, 40 (CCPA 1971)); TMEP §1207.01(b).  Although the marks can be differentiated in a side-by-side comparison because the registrant’s mark has different design and word elements, the marks are sufficiently similar in terms of their commercial impression related to the identical use of the stylized term “adidas” that consumers who encounter the marks would be likely to assume a connection between the parties. 

 

Therefore, the marks are confusingly similar.

 

COMPARISON OF THE GOODS

 

The goods and/or services are compared to determine whether they are similar, commercially related, or travel in the same trade channels.  See Coach Servs., Inc. v. Triumph Learning LLC, 668 F.3d 1356, 1369-71, 101 USPQ2d 1713, 1722-23 (Fed. Cir. 2012); Herbko Int’l, Inc. v. Kappa Books, Inc., 308 F.3d 1156, 1165, 64 USPQ2d 1375, 1381 (Fed. Cir. 2002); TMEP §§1207.01, 1207.01(a)(vi).

 

Applicant’s goods are waterproofing chemical compositions, leather-waterproofing chemicals, shoe cleaning preparations, leather cleaning preparations, leather conditioning preparations, suede cleaning preparations, suede conditioning preparations, shoe polishes, cleaning sponges sold with shoe cleaning and conditioning preparations, shoe brushes sold with shoe cleaning and conditioning preparations, and shoe deodorizers. 

 

In general, applicant’s goods are products for use in connection with shoes. 

 

The goods in U.S. Registration No. 4351977 include footwear.

 

If the goods and/or services of the respective parties are “similar in kind and/or closely related,” the degree of similarity between the marks required to support a finding of likelihood of confusion is not as great as would be required with diverse goods and/or services.  In re J.M. Originals Inc., 6 USPQ2d 1393, 1394 (TTAB 1987); see Shen Mfg. Co. v. Ritz Hotel Ltd., 393 F.3d 1238, 1242, 73 USPQ2d 1350, 1354 (Fed. Cir. 2004); TMEP §1207.01(b).

 

Applicant’s goods and registrant’s goods are similar in kind and/or closely related because the goods are complementary products.  In particular, applicant’s specific shoe products listed in the application would be used to waterproof, clean, polish and deodorize applicant’s footwear.  In addition, the applicant’s goods and registrant’s goods are often sold in the same channels of trade.  Thus, the contemporaneous use of the same stylized term “adidas” for complementary products in the nature of shoe products and footwear is like to cause consumer confusion as to the source of such goods. 

 

The compared goods and/or services need not be identical or even competitive to find a likelihood of confusion.  See On-line Careline Inc. v. Am. Online Inc., 229 F.3d 1080, 1086, 56 USPQ2d 1471, 1475 (Fed. Cir. 2000); Recot, Inc. v. Becton, 214 F.3d 1322, 1329, 54 USPQ2d 1894, 1898 (Fed. Cir. 2000); TMEP §1207.01(a)(i).  They need only be “related in some manner and/or if the circumstances surrounding their marketing are such that they could give rise to the mistaken belief that [the goods and/or services] emanate from the same source.”  Coach Servs., Inc. v. Triumph Learning LLC, 668 F.3d 1356, 1369, 101 USPQ2d 1713, 1722 (Fed. Cir. 2012) (quoting 7-Eleven Inc. v. Wechsler, 83 USPQ2d 1715, 1724 (TTAB 2007)); TMEP §1207.01(a)(i).

 

In the present case, the following webpages show use of applicant’s adidas goods in this application as well as footwear for sale at the same retail store locations and in particular under the adidas brand, namely:

 

1.     See attached webpages for the retailer “Amazon” for applicant’s adidas cleaning care kit and adidas footwear.

2.     See attached webpages for the retailer "END." for applicant's addidas cleaning drop set and footwear including adidas footwear.

 

The attached Internet evidence establishes that the relevant goods are sold or provided through the same trade channels and used by the same classes of consumers in the same fields of use.  Moreover, it is reasonable that the goods at issue have complementary uses considering applicant’s goods are used on shoe which is a type of footwear and registrant’s goods are footwear.  Thus, the goods are often used together or otherwise purchased by the same purchasers, and such goods have generally been found to be sufficiently related such that confusion would be likely if they are marketed under the same or similar marks.  See In re Martin’s Famous Pastry Shoppe, Inc., 748 F.2d 1565, 1567, 223 USPQ 1289, 1290 (Fed. Cir. 1984) (holding bread and cheese to be related because they are often used in combination and noting that “[s]uch complementary use has long been recognized as a relevant consideration in determining a likelihood of confusion”); In re Toshiba Med. Sys. Corp., 91 USPQ2d 1266, 1272 (TTAB 2009) (holding medical MRI diagnostic apparatus and medical ultrasound devices to be related, based in part on the fact that such goods have complementary purposes because they may be used by the same medical personnel on the same patients to treat the same disease). 

 

Thus, applicant’s and registrant’s goods and/or services are considered related for likelihood of confusion purposes.  See, e.g., In re Davey Prods. Pty Ltd., 92 USPQ2d 1198, 1202-04 (TTAB 2009); In re Toshiba Med. Sys. Corp., 91 USPQ2d 1266, 1268-69, 1271-72 (TTAB 2009).

 

CONCLUSION

 

Couple the similarity in commercial impression based on the identical use of the stylized word “adidas” along with the related nature of the goods and a consumer encountering both marks may wrongly assume that the goods are derived from a common commercial source.

 

The overriding concern is not only to prevent buyer confusion as to the source of the goods and/or services, but to protect the registrant from adverse commercial impact due to use of a similar mark by a newcomer.  See In re Shell Oil Co., 992 F.2d 1204, 1208, 26 USPQ2d 1687, 1690 (Fed. Cir. 1993).  Therefore, any doubt regarding a likelihood of confusion determination is resolved in favor of the registrant.  TMEP §1207.01(d)(i); see Hewlett-Packard Co. v. Packard Press, Inc., 281 F.3d 1261, 1265, 62 USPQ2d 1001, 1003 (Fed. Cir. 2002); In re Hyper Shoppes (Ohio), Inc., 837 F.2d 463, 464-65, 6 USPQ2d 1025, 1026 (Fed. Cir. 1988).

 

Although applicant’s mark has been refused registration, applicant may respond to the refusal by submitting evidence and arguments in support of registration.

 

OWNERSHIP OF CITED REGISTRATION

 

If the mark in the cited registration is owned by applicant, applicant may provide evidence of ownership of the mark by satisfying one of the following:

 

(1)       Record the assignment with the USPTO’s Assignment Recordation Branch (ownership transfer documents such as assignments can be filed online at http://etas.uspto.gov) and promptly notify the trademark examining attorney that the assignment has been duly recorded.

 

(2)       Submit copies of documents evidencing the chain of title.

 

(3)       Submit the following statement, verified with an affidavit or signed declaration under 37 C.F.R. §2.20: Applicant is the owner of U.S. Registration No. 4351977.  To provide this statement using the Trademark Electronic Application System (TEAS), use the “Response to Office Action” form; answer “yes” to wizard questions #3 and #10; then, continuing on to the next portion of the form, in the “Additional Statement(s)” section, find “Active Prior Registration(s)” and insert the U.S. registration numbers in the data fields; and follow the instructions within the form for signing.  The form must be signed twice; a signature is required both in the “Declaration Signature” section and in the “Response Signature” section.

Recording a document with the Assignment Recordation Branch does not constitute a response to an Office action.  TMEP §503.01(d).

REQUIREMENT(S)

 

If applicant responds to the refusal(s), applicant must also respond to the requirement(s) set forth below.

 

CLASSIFICATION AND IDENTIFICATION OF GOODS/MULTIPLE-CLASS APPLICATION REQUIREMENTS

 

INTERNATIONAL CLASS 5

Although acceptable as written, applicant may wish to insert the word “and” before the goods “leather-waterproofing chemicals” so that the identification is grammatically clear and concise.  In the alternative, for a clear and concise identification, applicant may wish to replace the comma with a semicolon in the identification to clearly distinguish and list the goods as set forth in the identification.

 

INTERNATIONAL CLASS 3

The following wording in the identification of goods is indefinite and must be clarified because the wording does not make clear the exact nature of the goods with enough specificity by common commercial name for proper identification and classification of the good in this class and/or the wording is too broad and could include goods in other classes, namely:

 

  1. leather conditioning preparations [Applicant must indicate the nature of the leather conditioning preparations by common commercial name and classify the goods accordingly.  The nature of the conditioning preparations may encompass goods such as creams for leather and waxes for leather in International Class 3 or leather preserving oil and grease in International Class 4 or some other goods by common commercial name.];
  2. suede conditioning preparations [Applicant must indicate the nature of the suede conditioning preparations by common commercial name and classify the goods accordingly.  The nature of the conditioning preparations may encompass goods such as creams for suede and waxes for suede in International Class 3 or suede preserving oil and grease in International Class 4 or some other goods by common commercial name.];
  3. cleaning sponges sold with shoe cleaning and conditioning preparations [Applicant must clarify the nature of the goods as the wording leaves unclear if the goods are cleaning sponges which are sold impregnated with shoe cleaning and conditioning preparations or cleaning sponges which are sold with shoe cleaning and conditioning preparations sold as a unit or separately.  Moreover, the nature of the shoe conditioning preparations must be further clarified by common commercial name if sold as a unit or impregnated.  Cleaning sponges are properly classified in International Class 21.  However, if the cleaning sponges are impregnated, the goods should be classified in the class in which the impregnated item is classified which most likely will be International Class 3.  Moreover, if the goods are all separate goods which are sold as a unit, applicant may classify the goods according to the predominant item(s) in the list of goods.];
  4. shoe brushes sold with shoe cleaning and conditioning preparations [Applicant must clarify the nature of the goods as the wording leaves unclear if the goods are shoe brushes which are sold impregnated with shoe cleaning and conditioning preparations or shoe brushes which are sold with shoe cleaning and conditioning preparations sold as a unit or separately.  Moreover, the nature of the shoe conditioning preparations must be further clarified by common commercial name if sold as a unit or impregnated.  Shoe brushes are properly classified in International Class 21.  However, if the shoe brushes are impregnated, the goods should be classified in the class in which the impregnated item is classified which most likely will be International Class 3.  Moreover, if the goods are all separate goods which are sold as a unit, applicant may classify the goods according to the predominant item(s) in the list of goods.].

 

See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.  Applicant must amend this wording to specify the common commercial or generic name of the goods.  See TMEP §1402.01.  If the goods have no common commercial or generic name, applicant must describe the product, its main purpose, and its intended uses.  See id.

 

INTERNATIONAL CLASS 5

The identification of goods in International Class 5 is acceptable as written.

Applicant may substitute the following wording, if accurate: 

 

Waterproofing chemical compositions, and leather-waterproofing chemicals, International Class 1; and/or

 

Shoe cleaning preparations, leather cleaning preparations, leather conditioning preparations, namely, creams for leather and waxes for leather, suede cleaning preparations, suede conditioning preparations, namely, creams for suede and waxes for suede, shoe polishes, cleaning sponges impregnated with shoe cleaning preparations and shoe conditioning preparations in the nature of shoe wax and shoe cream, shoe brushes impregnated with shoe cleaning preparations and conditioning preparations in the nature of shoe wax and shoe cream, cleaning sponges, shoe cleaning preparations, and shoe conditioning preparations in the nature of shoe wax and shoe cream all sold as a unit, and shoe brushes, shoe cleaning preparations and conditioning preparations in the nature of shoe wax and shoe cream all sold as a unit, International Class 3; and/or

 

Leather conditioning preparations, namely, grease for leather and oils for the preservation of leather; suede conditioning preparations, namely, grease for suede and oils for the preservation of suede, International Class 4; and/or

 

Shoe deodorizers, International Class 5; and/or

 

Cleaning sponges sold in connection with shoe cleaning and conditioning preparations, and shoe brushes sold in connection with shoe cleaning and conditioning preparations, International Class 21.

 

Applicant’s goods and/or services may be clarified or limited, but may not be expanded beyond those originally itemized in the application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Applicant may clarify or limit the identification by inserting qualifying language or deleting items to result in a more specific identification; however, applicant may not substitute different goods and/or services or add goods and/or services not found or encompassed by those in the original application or as acceptably amended.  See TMEP §1402.06(a)-(b).  The scope of the goods and/or services sets the outer limit for any changes to the identification and is generally determined by the ordinary meaning of the wording in the identification.  TMEP §§1402.06(b), 1402.07(a)-(b).  Any acceptable changes to the goods and/or services will further limit scope, and once goods and/or services are deleted, they are not permitted to be reinserted.  TMEP §1402.07(e).

 

MULTIPLE-CLASS APPLICATION REQUIREMENTS

 

The application references goods and/or services based on use in commerce in more than one international class; therefore, applicant must satisfy all the requirements below for each international class:

 

(1)       List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class (for example, International Class 3: perfume; International Class 18: cosmetic bags sold empty).

 

(2)       Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule).  Specifically, the application identifies goods and/or services based on use in commerce that are classified in at least four classes; however, applicant submitted a fee(s) sufficient for only three class(es).  Applicant must either (a) submit the filing fees for the classes not covered by the submitted fees or (b) restrict the application to the number of classes covered by the fees already paid.

 

(3)       Submit verified dates of first use of the mark anywhere and in commerce for each international class.  See more information about verified dates of use.

 

(4)       Submit a specimen for each international class.  The current specimen is acceptable for class(es) 1, 3, 5, and 21; and applicant needs a specimen for class(es).  See more information about specimens.

 

            Examples of specimens for goods include tags, labels, instruction manuals, containers, and photographs that show the mark on the actual goods or packaging, or displays associated with the actual goods at their point of sale.  Webpages may also be specimens for goods when they include a picture or textual description of the goods associated with the mark and the means to order the goods.  

 

(5)       Submit a verified statement that “The specimen was in use in commerce on or in connection with the goods and/or services listed in the application at least as early as the filing date of the application.  See more information about verification.
