USPTO database searched; no conflicting marks found.  The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

Application has been amended as shown below.  The trademark examining attorney is amending the application as follows.  No prior approval or authorization from applicant or applicant’s attorney is required.  TMEP §707.02.

The identification of goods is amended to remove typographical errors and redundancies and will read as follows:  “Cigarette cases; Cigarette cutters; Cigarette filters; Cigarette holders; Cigarette rolling machines; Cigarette rolling papers; Cigarette tobacco; Cigarettes; Smoker's articles, namely, filter tubes; Smoker's articles, namely, metal pocket-sized receptacles with lids for cigarette butts; Smokers' articles, namely, cigar storage tubes; Smokers' articles, namely, hookah charcoal; Smokers' articles, namely, outdoor cigar and cigarette disposal units; Smokers' articles, namely, rehydration tubes; Smokers' clips for securing hand rolled cigarettes; Smokers' mouthpieces for cigarettes; Smokers' oral vaporizer refill cartridges sold empty; Smokers' rolling trays; Smokers' storage vaults for cigarettes and cigars; Smokers’ articles in the nature of hemp wicks for lighting; Ashtrays for smokers; Ashtrays for smokers made of non-precious metals; Cartridges sold filled with chemical flavorings in liquid form for electronic cigarettes; Chemical flavorings for the preparation of tobacco, namely, cigarette tobacco, chewing tobacco and snuff; Chemical flavorings in liquid form used to refill electronic cigarette cartridges; Cigar and cigarette boxes; Cigarette-rolling machines; Electronic cigarette lanyards; Electronic cigarette liquid (e-liquid) comprised of flavorings in liquid form, other than essential oils, used to refill electronic cigarette cartridges; Electronic cigarettes; Hand-held machines for injecting tobacco into cigarette tubes; Holder for a cigarette pack and lighter; Lighters for smokers; Liquid nicotine solutions for use in electronic cigarettes; Oral vaporizers for smokers; Pocket appliances for rolling one's own cigarettes; Tobacco, cigars and cigarettes”  See TMEP §§1402.01, 1402.01(e).
