DATABASE SEARCH: The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
ISSUES APPLICANT MUST ADDRESS: On December 12, 2018, the trademark examining attorney and Richard Kim discussed the issues below. Applicant must timely respond to these issues. See 15 U.S.C. §1062(b); 37 C.F.R. §2.62(a); TMEP §§708, 711.
IDENTIFICATION OF GOODS
PARTIAL REQUIREMENT
If applicant does not respond within six months of the mailing date of this Office action, the following goods to which the requirement applies will be deleted from the application by Examiner’s Amendment: Pharmaceutical preparations. The application will then proceed forward for the remaining goods: Pharmaceutical preparations for treatment of oncologic, inflammatory and auto-immune diseases and disorders; pharmaceutical preparations for treatment of arthritis; pharmaceutical preparations for treatment of diseases and disorders of the blood, skin, bone marrow, nervous system, immune system and joints; pharmaceutical preparations for treatment of non-Hodgkin's lymphoma (NHL), chronic lymphocytic leukemia (CLL), rheumatoid arthritis (RA), granulomatosis with polyangiitis (GPA), microscopic polyangiitis (MPA), pemphigus vulgaris (PV), multiple sclerosis (MS), and stem cell transplantation. 15 U.S.C. §1062(b); 37 C.F.R. §2.65(a).
Applicant may substitute the following wording, if accurate: “Pharmaceutical preparations for acting on the central nervous system; pharmaceutical preparations for treatment of oncologic, inflammatory and auto-immune diseases and disorders; pharmaceutical preparations for treatment of arthritis; pharmaceutical preparations for treatment of diseases and disorders of the blood, skin, bone marrow, nervous system, immune system and joints; pharmaceutical preparations for treatment of non-Hodgkin's lymphoma (NHL), chronic lymphocytic leukemia (CLL), rheumatoid arthritis (RA), granulomatosis with polyangiitis (GPA), microscopic polyangiitis (MPA), pemphigus vulgaris (PV), multiple sclerosis (MS), and stem cell transplantation.”
