Serial number(s) 87933451 and 87933488 should not be used as a citation(s) under Section 2(d), in the event that said serial number(s) mature(s) into a registration(s). The applicant hereby requests removal of this application from suspension, based on the following arguments. If the examining attorney is not persuaded by these arguments, the applicant hereby requests that this application be returned to suspended status, awaiting ultimate disposition of the referenced serial number(s).

ARGUMENT(S)
Applicant and Automated Ag Systems, LLC, the owner of the applications cited in the Suspension Notice, agree that the use and registration of their respective marks will not result in a likelihood of confusion. Applicant and Automated Ag Systems, LLC have entered into a Consent and Coexistence Agreement, pursuant to which Automated Ag Systems, LLC consents to Bandit Industries registration of the subject mark. A copy of the agreement is attached hereto. Applicant also requests that the identification of goods be amended as proposed in the Suspension Notice to the following: Industrial machinery, namely, wood and brush chipping and grinding machines. Accordingly, Applicant respectfully requests that the Examining Attorney withdraw the Suspension Notice and approve the subject application for publication.
