In response to the substantive refusal(s), please note the following:

Comparison to Reg. No. 5370986 Applicant has dropped Class 36 from the Application. Although both marks relate to the mortgage brokerage industry, the marks represent very different services. The applied-for mark represents a training program for new loan officers working for the Applicant?s mortgage brokerage, while the registered mark represents traditional mortgage brokerage services provided by the Owner of the registered mark. Comparison to Reg. No. 5428044 Although both marks are classified as Class 41, the marks represent very different services. The applied-for mark represents a training program for new loan officers working for the Applicant?s mortgage brokerage, while the registered mark represents general business consultancy services. Comparison to Ser. No. 87712507 Although both marks are classified as Class 41, the marks represent very different services. The applied-for mark represents a training program for new loan officers working for the Applicant?s mortgage brokerage, while the prior pending application mark represents entrepreneurial consultancy services for small businesses in the State of Alabama. The prior pending applicant?s services appear to be available only in Alabama; Applicant?s services are not available in Alabama.

The mark consists of a triangle outline with a six-sided geometric figure creating a gap in the center of the triangle outline. The triangle outline consists of three distinct parts, each covering one side and one apex. Each part is represented by a different color: one blue, one yellow, and one black. Immediately below the triangle outline is the literal element "LaunchPad" in black.
