SEARCH OF OFFICE’S DATABASE OF MARKS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
The following description is suggested, if accurate: The mark consists of a stylized heart consisting of two irregular polygons, the left side containing a plus symbol, the right side containing two dots diagonally oriented. The black background merely serves as transparent areas and is not claimed as a feature of the mark.

The following wording is acceptable in this class: “Audio, video and multimedia broadcasting via the Internet and other communications networks;”
The wording “streaming of games on the Internet;” in the identification of services is indefinite and must be clarified because the nature of the services is unclear whether applicant is primarily providing a transmission/telecommunications service or an entertainment service. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. Applicant may substitute the following wording, if accurate: “Electronic transmission in the nature of streaming of digital media content in the nature of electronic games for others via global and local computer networks” in International Class 038.
The following wording is acceptable in this class: “webcasting services; transmission of messages, data and content via the Internet and other communications networks;”
The wording “providing online forums;” in the identification of services is indefinite and must be clarified because the purpose is not specified. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. Applicant may substitute the following wording, if accurate: “Providing on-line forums for transmission of messages among computer users” in International Class 038.
The following wording is acceptable in this class: “providing internet chat rooms; transmission of electronic media, multimedia content, videos, movies, pictures, images, text, photos, user-generated content, audio content, and information via the Internet and other communications networks; providing online community forums for users to post, search, watch, share, critique, rate, and comment on, videos and other multimedia content via the Internet and other communications networks; providing access to computer, electronic and online databases; Consulting services in the field of communications”.

The following wording is acceptable in this class: “Organizing community sporting and cultural events;”
The wording “entertainment services, namely, providing online games;” in the identification of services is indefinite and must be clarified because it must specify the type of online games. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. Applicant may substitute the following wording, if accurate: “providing online electronic games; providing online computer games; providing online board games” in International Class 041.
The wording “entertainment services, namely, live performances by game players;” in the identification of services is indefinite and must be clarified because it is unclear how game players perform. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. Applicant may substitute the following wording, if accurate: “Entertainment services, namely, live performances in the nature of live appearances by celebrity game show players and celebrity computer gamers” in International Class 041.
The following wording is acceptable in this class: “entertainment services, namely, organizing and producing gaming and music events;”
The wording “educational services, namely, providing a website featuring non-downloadable instructional electronic media, multimedia content, videos, movies, pictures, images, text, photos, user-generated content, audio content, gaming content in the fields of electronic games, culture, technology and general interest” in the identification of services is indefinite and must be clarified because it is unclear whether applicant is providing educational services, or just providing media with information which is by its very nature, as all information is, educational. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. Applicant may substitute the following wording, if accurate: “Providing education courses via a website in the fields of electronic games, culture, technology and general interest, offered through online, non-downloadable media content in the form of instructional audiovisual electronic media, multimedia content, videos, movies, pictures, images, text, photos, user-generated content, audio content, and educational gaming content” in International Class 041.
The following wording is acceptable in this class: “on-line journals, namely, blogs featuring user-defined content;”
The wording “electronic publishing services, namely, publication of online works featuring information in the field of electronic media, multimedia content, videos, movies, pictures, images, text, photos, user-generated content, audio content, gaming content and related information;” in the identification of services is indefinite and must be clarified because the nature of the publishing services is unclear. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. Applicant may substitute the following wording, if accurate: “Electronic publishing services, namely, digital video, audio, and multimedia publishing services for the publication of online works featuring information in the field of electronic media, multimedia content, videos, movies, pictures, images, text, photos, user-generated content, audio content, gaming content and related information” in International Class 041.
The following wording is acceptable in this class: “publishing of electronic publications; digital video, audio and multimedia entertainment publishing services; entertainment services, namely, conducting contests; video production consulting services”.

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820. TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services. 37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.
