PARTIAL ABANDONMENT – APPLICATION HAS BEEN AMENDED
The above-referenced application is partially abandoned because applicant did not file a notice of appeal to the Trademark Trial and Appeal Board within six months from the date of issuance of the final Office action, and there is no time remaining in the six-month period. See 15 U.S.C. §1062(b); 37 C.F.R. §§2.65(a)-(a)(1), 2.142(a); TMEP §§715.01, 718.02(a).
The final Office action dated June 20, 2019 included requirements that applied to only a portion of the application. Applicant submitted a request for reconsideration that adequately amended some, but not all of the identification of goods, as required. Specifically, some of the amended language in Class 41 of the identification of services contained indefinite entries or improper punctuation. Therefore, only the portion of the application that is still unacceptable is abandoned. See 15 U.S.C. §1062(b); 37 C.F.R. §2.65(a)(1); TMEP §718.02(a).
The following portion of the identification that was the subject of the requirements but not adequately amended will be deleted from the application:
Class 41: “Arranging and conducting entertainment and educational exhibitions, conferences, and symposia, producing video games and multimedia entertainment; production and distribution of virtual reality and augmented reality entertainment.”
The application will proceed with the following identification:
Class 41: “Education services, namely, providing classes, seminars and workshops in the fields of building, electronics, and photography; production and distribution of music, films and television shows; fan club services.”
