I have reviewed your client’s trademark application serial no. 88096295 and found no conflicting marks. However, there are two remaining issues:
Disclaimer Requirement: The term “CERVEZA” requires a disclaimer because it is merely descriptive of a feature/characteristic of applicant’s identified goods, and thus an un-registrable component of the mark. TMEP §§1213, 1213.03(a). The following is the accepted standard format for a disclaimer: No claim is made to the exclusive right to use “CERVEZA” apart from the mark as shown.
Translation Statement: The word CERVEZA in the applied for mark requires a translation. Please advise if your client authorizes the following statement being added to the record: The English translation of "CERVEZA" in the mark is "BEER".
Upon authorization, I can note the changes via Examiner’s Amendment. Please let me know how you wish to proceed.
