TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820. TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services. 37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04. However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.
This Office action is in response to applicant’s communication filed on March 18, 2019.
Upon reconsideration, the Section 2(d) likelihood of confusion refusal based on U.S. Registration Nos. 2004295, 2026072, and 2549490 is withdrawn as to the following goods only: “Children's magazines in the field of educational activities.” Also, the applicant’s amended identification of goods has been entered.
However, the applicant must respond to the following FINAL refusals:
Section 2(d) Refusal – Likelihood of Confusion – Partial Refusal - FINAL
THIS REFUSAL APPLIES ONLY TO THE GOODS “CHILDREN’S BOOKS”.
Although not all du Pont factors may be relevant, there are generally two key considerations in any likelihood of confusion analysis: (1) the similarities between the compared marks and (2) the relatedness of the compared goods and/or services. See In re i.am.symbolic, llc, 866 F.3d at 1322, 123 USPQ2d at 1747 (quoting Herbko Int’l, Inc. v. Kappa Books, Inc., 308 F.3d 1156, 1164-65, 64 USPQ2d 1375, 1380 (Fed. Cir. 2002)); Federated Foods, Inc. v. Fort Howard Paper Co.,544 F.2d 1098, 1103, 192 USPQ 24, 29 (C.C.P.A. 1976) (“The fundamental inquiry mandated by [Section] 2(d) goes to the cumulative effect of differences in the essential characteristics of the goods [or services] and differences in the marks.”); TMEP §1207.01.
In its response, applicant argues that its stylized mark is sufficiently distinct to avoid confusion. Applicant states that the presence of the “smiling H” feature in the applied-for mark creates a distinct and different commercial impression and that this feature has become closely associated with applicant and its various children’s magazine properties over more than sixty years. Applicant references various prior registrations with the “smiling H” feature for similar goods and services and argues that in light of applicant’s substantial prior use and registration of the “smiling H” in various formats and for closely related goods and services, it reasonable to conclude that consumers consider the design to be the dominant portion of the currently applied-for mark, which has been in use since January 2017.
In this case, however, the stylized letter “H” of the applicant’s mark is not the dominant feature of the mark. When evaluating a composite mark consisting of words and a design, the word portion is normally accorded greater weight because it is likely to make a greater impression upon purchasers, be remembered by them, and be used by them to refer to or request the goods and/or services. In re Aquitaine Wine USA, LLC, 126 USPQ2d 1181, 1184 (TTAB 2018) (citing In re Viterra Inc., 671 F.3d 1358, 1362, 101 USPQ2d 1905, 1908 (Fed. Cir. 2012)); TMEP §1207.01(c)(ii). Thus, although marks must be compared in their entireties, the word portion is often considered the dominant feature and is accorded greater weight in determining whether marks are confusingly similar, even where the word portion has been disclaimed. In re Viterra Inc., 671 F.3d at 1366-67, 101 USPQ2d at 1911 (citing Giant Food, Inc. v. Nation’s Foodservice, Inc., 710 F.2d 1565, 1570-71, 218 USPQ2d 390, 395 (Fed. Cir. 1983)).
In this case, when considering the mark in its entirety, it is the wording HELLO in applicant’s mark that is the dominant feature of the mark because, as wording, it is likely to make a greater impression upon purchasers, be remembered by them, and be used by them to refer to or request the goods. The applicant’s stylization of the letter “H” is merely a portion of the wording HELLO of the mark; consumers are more likely to remember and/or call for the goods in the present case by using the wording HELLO itself, not by using a stylized letter of such word, and therefore applicant’s argument that the smiling letter H of the mark is dominant is unpersuasive.
In its response, the applicant argues that the cited registered marks create differing commercial impressions due to the differences in the design elements, appearance, sound and meaning of the applicant’s mark and cited marks.
The examining attorney has carefully considered these arguments but finds them unpersuasive. Despite the differing design elements in applicant’s and cited registered marks, the marks at issue remain similar in sound because applicant’s mark and all cited marks share the identical sounding word HELLO. The design elements also do not distinguish the applicant’s or registered marks because, as discussed above, the design elements are less significant in the likelihood of confusion analysis than the wording of each mark. Further, although marks are compared in their entireties, one feature of a mark may be more significant or dominant in creating a commercial impression. See In re Viterra Inc., 671 F.3d 1358, 1362, 101 USPQ2d 1905, 1908 (Fed. Cir. 2012); In re Nat’l Data Corp., 753 F.2d 1056, 1058, 224 USPQ 749, 751 (Fed. Cir. 1985); TMEP §1207.01(b)(viii), (c)(ii). Disclaimed matter that is descriptive of or generic for a party’s goods and/or services is typically less significant or less dominant when comparing marks. In re Detroit Athletic Co., 903 F.3d 1297, 1305, 128 USPQ2d 1047, 1050 (Fed. Cir. 2018) (citing In re Dixie Rests., Inc., 105 F.3d 1405, 1407, 41 USPQ2d 1531, 1533-34 (Fed. Cir. 1997)); TMEP §1207.01(b)(viii), (c)(ii). In this case, it is the word HELLO in each cited mark that is more significant or dominant in creating a commercial impression because the wording READER and MATH READER in the cited marks is less significant as disclaimed matter. See cited registrations showing the disclaimer of the wording “reader” and “math reader.”
In its response, the applicant also argues that numerous third party registrations that incorporate the wording HELLO in the marks for similar goods co-exist on the register and therefore the applicant’s mark should also be allowed to register. The examining attorney has carefully considered this argument but finds it unpersuasive. First, applicant has submitted a list of registrations. However, the mere submission of a list of registrations or a copy of a private company search report does not make such registrations part of the record. See In re Peace Love World Live, LLC, 127 USPQ2d 1400, 1405 n.17 (TTAB 2018) (citing In re 1st USA Realty Prof’ls, 84 USPQ2d 1581, 1583 (TTAB 2007); In re Duofold Inc., 184 USPQ 638, 640 (TTAB 1974)); TBMP §1208.02; TMEP §710.03. To make third party registrations part of the record, an applicant must submit copies of the registrations, or the complete electronic equivalent from the USPTO’s automated systems, prior to appeal. In re Star Belly Stitcher, Inc., 107 USPQ2d 2059, 2064 (TTAB 2013); TBMP §1208.02; TMEP §710.03. Accordingly, these registrations will not be considered.
In this case, the application uses broad wording to describe “children's books,” which presumably encompasses all goods of the type described, including registrant’s more narrow “series of books for children” and “series of children's books relating to the subject of mathematics.” See, e.g., In re Solid State Design Inc., 125 USPQ2d 1409, 1412-15 (TTAB 2018); Sw. Mgmt., Inc. v. Ocinomled, Ltd., 115 USPQ2d 1007, 1025 (TTAB 2015). Thus, applicant’s and registrant’s goods are legally identical. See, e.g., In re i.am.symbolic, llc, 127 USPQ2d 1627, 1629 (TTAB 2018) (citing Tuxedo Monopoly, Inc. v.Gen. Mills Fun Grp., Inc., 648 F.2d 1335, 1336, 209 USPQ 986, 988 (C.C.P.A. 1981); Inter IKEA Sys. B.V. v. Akea, LLC, 110 USPQ2d 1734, 1745 (TTAB 2014); Baseball Am. Inc. v. Powerplay Sports Ltd., 71 USPQ2d 1844, 1847 n.9 (TTAB 2004)).
Additionally, the goods of the parties have no restrictions as to nature, type, channels of trade, or classes of purchasers and are “presumed to travel in the same channels of trade to the same class of purchasers.” In re Viterra Inc., 671 F.3d 1358, 1362, 101 USPQ2d 1905, 1908 (Fed. Cir. 2012) (quoting Hewlett-Packard Co. v. Packard Press, Inc., 281 F.3d 1261, 1268, 62 USPQ2d 1001, 1005 (Fed. Cir. 2002)). Thus, applicant’s and registrant’s goods are related.
This refusal is made FINAL.
Title of a Single Work – Goods – Partial Refusal – FINAL
THIS REFUSAL APPLIES ONLY TO THE GOODS “CHILDREN’S BOOKS”.
In this case, the submitted specimen shows the applied-for mark, HELLO, appearing on the front cover of different magazines. However, there is no evidence in the application record that applicant’s books are part of a series of works, nor are there specimens or evidence in the record otherwise showing proper trademark use of the applied-for mark for the applicant’s books.
Therefore, consumers would view the applied-for mark as the title of a single work, rather than as a trademark to indicate the source of applicant’s goods and to distinguish applicant’s goods from others.
In its response, applicant also submitted a substitute specimen webpage asserting that its mark shows use on a collection of various children's board books. The examining attorney has carefully considered this evidence but finds it unpersuasive. The webpage evidence does show various children’s board books but the webpage does not show the applicant’s mark HELLO on the webpage and therefore does not show use of the mark in commerce in connection with applicant’s books.
In appropriate circumstances, applicant may overcome this refusal by satisfying one of the following options:
(1) Submit evidence that the applied-for mark is used to identify a series of creative works.
(2) Amend the filing basis to intent to use under Section 1(b). This option will later necessitate additional fee(s) and filing requirements.

Stated Refusal Pertains to Specific Goods
(1) Deleting the goods and/or services to which the refusal pertains;
(2) Filing a request to divide out the goods and/or services that have not been refused registration, so that the mark may proceed toward publication for opposition for those goods or services to which the refusal does not pertain. See 37 C.F.R. §2.87. See generally TMEP §§1110 et seq. (regarding the requirements for filing a request to divide). If applicant files a request to divide, then to avoid abandonment, applicant must also file a timely response to all outstanding issues in this Office action, including the refusal. 37 C.F.R. §2.87(e); or
(3) Amending the basis for the goods and/or services identified in the refusal, if appropriate. TMEP §806.03(h). (The basis cannot be changed for applications filed under Trademark Act Section 66(a). TMEP §1904.01(a).)
Proper Response to Final Office Action – Full Refusal
The application will then proceed for the following goods: “Children's magazines in the field of educational activities.”
Applicant may respond by providing one or both of the following:
(1) a response filed using the Trademark Electronic Application System (TEAS) that fully satisfies all outstanding requirements and/or resolves all outstanding refusals; and/or
(2) an appeal to the Trademark Trial and Appeal Board filed using the Electronic System for Trademark Trials and Appeals (ESTTA) with the required filing fee of $200 per class.
