Jennifer –
Thank you. We also agree to add the additional wording: “tile back board” and “interior wall, floor, and ceiling panels”.

The bolded wording is acceptable, but I still need the additional clarifications for the “tile backer” and “interior panels” wording, e.g., “tile backer boards” and “interior wall, floor and ceiling panels.”
So the fully amended identification would then be:
Cl 19: Gypsum wallboard; non-metal building and construction materials, namely shaft-liner for the construction of barriers for cavity shaftwalls, horizontal membrane systems, and area separation walls, tile backer boards, and interior wall, floor and ceiling panels
Let me know if this is an acceptable amended identification of goods for Class 19.

Dear Ms. Jones:
I have reviewed the above-referenced trademark application and there is an issue with the identification of goods that must be resolved before I can approve the application for publication. Specifically, the wording “Non-metal building and construction materials, namely, shaft-liner, tile backer, and interior panels” is indefinite because the applicant must more clearly explain the nature of these goods. For example, the following wording would be acceptable, if accurate:
Non-metal building and construction materials, namely, shaft-liner in the nature of liners for chimney shafts, tile backer boards, and interior wall, floor and ceiling panels
If the above amended wording is acceptable, I can enter this change by Examiner’s amendment with your approval. However, I must act on this application by the end of next week. Therefore, please respond with your instructions by 5:00pm on Thursday, September 27th. If you are unable to respond by that time, I will send an Office action making these requirements, but am still happy to do an Examiner’s amendment at a later date.
Thank you,
Jennifer H. Dixon
