DATABASE SEARCH:  The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

APPLICATION HAS BEEN AMENDED:  In accordance with the authorization granted by Kimberly A. Berger, Esq. on December 3, 2018, the trademark examining attorney has amended the application as indicated below.  Please advise the undersigned immediately of any objections.  Otherwise, no response is necessary.  TMEP §707.

 

The following description of the mark is added to the record:

 

            The mark consists of a top hat over the word "SHERLOCK" in block letters with the "O" in the shape of a magnifying glass and a stylized mustache under "ERLO" of "SHERLOCK". The shaded rectangular box surrounding the mark is meant to show contrast and is not claimed as a feature of the mark.

My name is Daniel Stringer and I am the trademark examining attorney assigned to review the above-referenced application.

 

The mark description must be amended to clarify whether the shaded rectangle surrounding the mark is a feature of the mark because certain elements identified in the mark description as being “shaded” are not actually shaded. Please find below my proposed mark description.
