Petition to Make Special

To the Commissioner for Trademarks:

The following is submitted for application serial number. 88074258

FORM INFORMATION

Applicant requests that its application for VOICEA (Application Serial No. 88074258) be made special to avoid litigation and expedite settlement of a trademark dispute.

Applicant’s current trademark, VOICERA (Application Serial No. 87615608), is the subject of threatened litigation by Vocera Communications, Inc., whose registered trademarks have been cited as the basis for a Section 2(d) refusal following the company’s submission of a Letter of Protest. Prompt approval of a replacement trademark is essential to a successful resolution of this dispute.

Expediting examination of the VOICEA application would not be futile. It is Applicant’s understanding that Vocera Communications, Inc., does not plan to object to Application Serial No. 88074258.

Accordingly, Applicant believes that granting this Petition to expedite examination of Application Serial No. 88074258 is warranted by the facts and evidence presented, and by the guidance provided by TMEP §1710, and such action is solicited.
