EXAMINER’S AMENDMENT

Issue date:  October 28, 2019

INTRODUCTION

This Examiner’s Amendment is in response to applicant’s communication with the trademark examining attorney on October 24, 2019 and October 28, 2019.

In a previous Office action(s) dated September 30, 2019, the trademark examining attorney required applicant to satisfy the following requirement:  amend the identification of goods.

Based on applicant’s October 17, 2019 response, the trademark examining attorney notes that the following requirement has been satisfied: definite amended identification provided.  See TMEP §§713.02, 714.04.

Further, the applicant subsequently submitted an amendment to allege use on October 24, 2019. The amendment to allege use has been reviewed by the assigned trademark examining attorney. The amendment to allege use satisfies the minimum filing requirements under 37 C.F.R. §2.76(c) and it satisfies all statutory requirements.

Application has been amended as shown below.  As agreed to by Kathryn E. Cox on October 24, 2019 and October 28, 2019, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

CLARIFICATION OF APPLICANT'S DOMICILE ADDRESS

Applicant has clarified its domicile street address as being 6601 74th Avenue, Milan, IL  61264.

See 37 C.F.R. §§2.2(o)-(p), 2.11(a), 2.189; Requirement of U.S.-Licensed Attorney for Foreign-Domiciled Trademark Applicants & Registrants, Examination Guide 4-19, at I.A. (Rev. Sept. 2019).
