DATABASE SEARCH:  The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

APPLICATION HAS BEEN AMENDED:  In accordance with the authorization granted by Janice Bader, Esq. on August 2, 2018, the trademark examining attorney has amended the application as indicated below.  Please advise the undersigned immediately of any objections.  Otherwise, no response is necessary.  TMEP §707.  Any amendments to the identification of goods and/or services may clarify or limit the goods and/or services, but may not add to or broaden the scope of the goods and/or services.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.

Identification of Goods and Services in International Classes 9, 42 and 44

The identification of goods and services in International Classes 9, 42 and 44 is amended to read as follows: 

 

Downloadable software relating to health and well-being, namely, therapeutic services, mindfulness services, facial and body treatment services, and cosmetic body care services, that allows personal care service providers to be dispatched to consumers upon request; downloadable software in the nature of a mobile application that allows providers of therapeutic services, mindfulness services, facial and body treatment services, and cosmetic body care services to be dispatched to consumers upon request; downloadable software relating to massage services, namely, downloadable software in the nature of a mobile application that allows massage therapists to be dispatched to consumers upon request; in International Class 9.

 

Providing non-downloadable, online software relating to health and well-being, namely, therapeutic services, mindfulness services, facial and body treatment services, and cosmetic body care services, that allows personal care service providers to be dispatched to consumers upon request; providing online non-downloadable software in the nature of a mobile application that allows providers of therapeutic services, mindfulness services, facial and body treatment services, and cosmetic body care services to be dispatched to consumers upon request; providing online non-downloadable software relating to massage services, namely, online non-downloadable software in the nature of a mobile application that allows massage therapists to be dispatched to consumers upon request; in International Class 42.

 

Providing wellness and health-related consulting services, namely, massage therapy services, mindfulness services, facial and body treatment services, and cosmetic body care services; providing on-site wellness and health-related  consulting services, namely, massage therapy services, mindfulness services, facial and body treatment services, and cosmetic body care services dispatched to consumers upon request; providing on-site massage therapy services dispatched to consumers upon request; provision of advice and information on the aforementioned services; in International Class 44.
