Dear Mr. Keam,
This is further to the Priority Action issued in conjunction with the above-referenced matter on October 31, 2018. Applicant would like to resolve this matter by Examiner's Amendment, if possible.
First, Applicant notes that apparently clarification was required with respect to the goods listed in Class 10. Applicant would like to amend the Class 10 goods as follows:
Medical diagnostic apparatus and instruments for use in preparing blood, bodily fluid and human biological samples for further testing and for the detection and identification of pathogen nucleic acids in blood, bodily fluids and biological samples; Analyzers for medical use for analyzing blood, bodily fluids and human biological samples; Analyzers for medical diagnosis for analyzing blood, bodily fluids and human biological samples; Medical and clinical diagnosis apparatus and machines, namely, molecular and immunoassay analyzers for analyzing blood and bodily fluids; Testing instruments for medical diagnostic purposes, namely, analyzers for detection and identification of pathogen nucleic acids in blood, bodily fluids and human biological samples; Apparatus for carrying-out diagnostic tests for medical purposes for testing blood bodily fluids and human biological samples
In addition, Applicant would like to delete the intent to use filing basis and proceed to publication based solely on the 44(e) filing basis.
