REQUIREMENT: IDENTIFICATION OF SERVICES CLARIFICATION

 

The wording “Technical consultation in the field of interoperability of networked audio video products” is too broad making the nature of the services identified unclear and could include services in multiple international classes.  For example, this could include “technical consultation in the field of the custom manufacture of interoperable audio video products” in International Class 40 or “technical consultation in the field of audio video products interoperability technology” in International Class 42.  Merely indicating that the services are “technical consultation” services does not make these services definite services in International Class 42.  Instead, the subject matter of the technical consultation determines the classification of the services.  Applicant must clarify the “interoperability of networked audio video products” subject matter in International Class 42 as is shown in the suggested identification below.

 

IC 35: No changes needed

 

IC 42: (Based on Use in Commerce) Design and development of technical specifications in the field of networked audio video products; Technical consultation in the field of {specify the interoperability subject matter in Class 42, e.g., audio video products interoperability technology, research relating to audio video products interoperability}, design and development of networked audio video products; Design and development of software in the field of networked audio video products; Design and development of software for testing networked audio video products
