Database Search: The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

Drawing

The drawing includes a black circle to the right of the term “BNSF,” which appears to be the registration symbol.  The applicant must submit a new drawing without this symbol because it is not part of the mark.  See 37 C.F.R. §2.72; TMEP §§807.02, 807.14(a).  Although deleting this symbol is permitted in this case, the applicant may not make any other changes or amendments that would materially alter the applied-for mark on the drawing.  See 37 C.F.R. §2.72; TMEP §807.14.  For more information about changes to the mark in the drawing after the application filing date, please go to the Drawing webpage.

 

Description of the Mark

The description of the mark is accurate but incomplete because it does not describe all the significant aspects of the applied-for mark.  The form described as a square is more accurately described as a rectangle, and the dot above the letter “I” is composed of a pin drop location symbol, which is not included in the current description of the mark.  Applications for marks not in standard characters must include an accurate and concise description of the entire mark that identifies literal elements as well as any design elements.  See 37 C.F.R. §2.37; TMEP §§808 et seq. 

 

Therefore, applicant must provide a more complete description of the applied-for mark.  The following description of the mark is suggested:

 

  • The mark consists of a rectangle with rounded edges containing the letters “BNSF” in capitalized block form on top of a triangle that is thickest under the “B” and becomes progressively thinner as it moves towards the “F”, with the word “RAILWAY” in capitalized block form under the thin part of the triangle under the letters “SF”, above the word “RIDE” with a stylized “I”, above a design of a train tracks.  The dot above the “I” is composed of a pin drop location symbol.
