Descriptiveness Determined in Relation to Goods/Services
“Whether consumers could guess what the product [or service] is from consideration of the mark alone is not the test.” In re Am. Greetings Corp., 226 USPQ 365, 366 (TTAB 1985).
The applicant applied to register the mark NOVEMBERTEENTH/APRILTEENTH for “Entertainment services, namely, providing a web site featuring photographic, video and prose presentations featuring Colonial History.” The proposed mark is descriptive, because it describes a feature of the relevant services. Novemberteenth/Aprilteenth is a period in Colonial history in which a document was delivered to the Virginia Colony’s new Governor issued by the Virginia Company of London on November 18, 1618 (Novemberteenth) and delivered by the new governor in the Virginia Colony on April 19, 1619 (Aprilteenth). The document was a declaration of absolute freedom for the Survivors of this 1st 12-year period of slavery within the Virginia Colony, 1607 to 1619 AD, which gives cause for the "Instructions to George Yeardley" document's issuance in November 1618, 400 years ago. Please see the attached Internet Evidence showing the descriptiveness of the term NOVEMBERTEENTH/APRILTEENTH.
The applicant provides “Entertainment services, namely, providing a web site featuring photographic, video and prose presentations featuring Colonial History” about the Novemberteenth/Aprilteenth period.
Therefore, the proposed mark is descriptive of the relevant services.

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.
