UNSIGNED APPLICATION

 

The application was unsigned, resulting in the application not being properly verified.  See 37 C.F.R. §§2.2(n), 2.33(a)-(b), 2.34(a)(1)(i), (a)(2), (a)(3)(i), (a)(4)(ii), 2.193(e)(1).  Applicant must properly sign and therefore verify the application in an affidavit or signed declaration under 37 C.F.R. §2.20.  37 C.F.R. §§2.2(n), 2.33(a)-(b), 2.34(a)(1)(i), (a)(2), (a)(3)(i), (a)(4)(ii), 2.193(e)(1); TMEP §804.02.

INQUIRY – SIGNIFICANCE OF WORDING

 

To permit proper examination of the application, Applicant must provide the following information:

 

(1)  Explain whether the wording in the mark has any meaning or significance in the industry in which the goods and services are manufactured or provided, or if such wording is a term of art within Applicant’s industry. 

 

(2)  Explain whether this wording identifies a geographic place or has any meaning in a foreign language. 

 

(3)  Submit an English translation of all foreign wording in a mark.  If the wording does not have meaning in a foreign language, Applicant should so specify.   

 

The format for an English translation and transliteration:  The English translation of the word "SOLIMO" in the mark is "______". 

 

The format for when there is no English translation:  The wording "SOLIMO" has no meaning in a foreign language. 

 

(4)  Respond to the following question: Does anyone connected to Applicant use "SOLIMO" as a surname?

AMENDED IDENTIFICATION OF GOODS AND SERVICES REQUIRED

 

Applicant has classified the following goods in International Class 3:  Disinfectant soap; Toilet cleaners.  However, the proper classification for each item is as follows: 

 

  • Disinfectant soap – International Class 5
  • Disinfectant toilet bowl cleaners – International Class 5

 

Applicant may respond by amending the foregoing entries to International Class 5, as set forth in the suggested amendment below.

 

The wording "soap" in the identification of goods for International Class 3 must be clarified because it is too broad and could include goods in other international classes.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.  In particular, this wording could encompass "non-medicated soap" in International Class 3, "medicated soap" in International Class 5, etc.

 

Applicant is advised to delete or modify the duplicate entry in the identification of goods in International Class 3 for "glass cleaners".  See generally TMEP §§1402.01, 1402.01(a).  If Applicant does not respond to this issue, be advised that the USPTO will remove duplicate entries from the identification prior to registration.

 

If modifying one of the duplicate entries, Applicant may amend it to clarify or limit the goods, but not to broaden or expand the goods beyond those in the original application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Also, generally, any deleted goods may not later be reinserted.  TMEP §1402.07(e).

 

The wording "mouthwash" in the identification of goods for International Class 3 must be clarified because it is too broad and could include goods in other international classes.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.  In particular, this wording could encompass "non-medicated mouthwash" in International Class 3, "medicated mouthwash" in International Class 5, etc.

 

The wording "air fresheners" in the identification of goods for International Class 5 must be clarified because it is too broad and could include goods in other international classes.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.  In particular, this wording could encompass "air fragrancing preparations" in International Class 3, "air deodorizing preparations" in International Class 5, etc.

 

The wording "meal replacement bars" in the identification of goods for International Class 5 must be clarified because it is too broad and could include goods in other international classes.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.  In particular, this wording could encompass "meal replacement bars adapted for medical use" in International Class 5, "fruit-based meal replacement bars" in International Class 29, "chocolate-based meal replacement bars" in International Class 30, etc.

 

The wording "cutlery" in the identification of goods for International Class 8 must be clarified because it is too broad and could include goods in other international classes.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.  In particular, this wording could encompass "table cutlery" in International Class 8, "surgical cutlery" in International Class 10, etc.

Additional portions of the wording in the identification of goods and services are unacceptable because they contain indefinite language and, thus, the nature of these goods and services is unclear, as set forth belowSee 37 C.F.R. §2.32(a)(6); TMEP §1402.01. The USPTO requires applicants to identify goods and services with specificity in order to provide public notice, to enable the USPTO to classify the goods and services properly, and to reach informed judgments concerning likelihood of confusion under 15 U.S.C. §1052(d).  The USPTO has discretion to require the degree of particularity deemed necessary to clearly identify the goods and services covered by the mark.   In re Omega SA, 494 F.3d 1362, 83 USPQ2d 1541 (Fed. Cir. 2007). Applicant may refer to the suggested amended identification of goods and/or services below.

 

The Trademark Act requires that a trademark or service mark application must include a “specification of … the goods or services” in connection with which the mark is being used or will be used.  15 U.S.C. §1051(a)(2) (emphasis added), (b)(2) (emphasis added); see 15 U.S.C. §1053.  Specifically, a complete application must include a “list of the particular goods or services on or in connection with which the applicant uses or intends to use the mark.”  37 C.F.R. §2.32(a)(6) (emphasis added).  This requirement for a specification of the particular goods or services applies to applications filed under all statutory bases.  See 15 U.S.C. §§1051(a)(2), 1051(b)(2), 1053, 1126(d)-(e), 1141f; 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.01(b)-(c).

 

“The purpose of the identification of goods and services is to provide the general population, including consumers and members of the relevant industry, with an understandable description of the goods and services, which is done by using the common commercial name for the goods and/or services.”  In re Gulf Coast Nutritionals, Inc., 106 USPQ2d 1243, 1247 (TTAB 2013) (citing In re Sones, 590 F.3d 1282, 1289, 93 USPQ2d 1118, 1124 (Fed. Cir. 2009)).  If there is no common, ordinary name for the goods and services, Applicant should describe the goods and services using wording that would be generally understood by the average person.  See Schenley Indus., Inc. v. Battistoni, 112 USPQ 485, 486 (Comm’r Pats. 1957); Cal. Spray-Chem. Corp. v. Osmose Wood Pres. Co. of Am., 102 USPQ 321, 322 (Comm’r Pats. 1954); TMEP §1402.01.

 

An in depth knowledge of the relevant field should not be necessary for understanding a description of the goods and services.  TMEP §1402.01.  “[T]echnical, high-sounding verbiage” should be avoided.  Cal. Spray-Chem. Corp. v. Osmose Wood Pres. Co. of Am., 102 USPQ at 322.

Scope Advisory

 

Applicant may amend the identification to clarify or limit the goods and services, but not to broaden or expand the goods and services beyond those in the original application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Generally, any deleted goods and services may not later be reinserted.  See TMEP §1402.07(e).  Additionally, for U.S. applications filed under Trademark Act Section 44(e), the scope of the identification for purposes of permissible amendments may not exceed the scope of the goods and services identified in the foreign registration.  37 C.F.R. §2.32(a)(6); Marmark, Ltd. v. Nutrexpa, S.A., 12 USPQ2d 1843, 1845 (TTAB 1989) (citing In re Löwenbräu München, 175 USPQ 178, 181 (TTAB 1972)); TMEP §§1012, 1402.01(b).

RESPONSE GUIDELINES

If Applicant does not respond to this Office action within six months of the issue/mailing date, or responds by expressly abandoning the application, the application process will end and the trademark will fail to register.  See 15 U.S.C. §1062(b); 37 C.F.R. §§2.65(a), 2.68(a); TMEP §§718.01, 718.02.  Additionally, the USPTO will not refund the application filing fee, which is a required processing fee.  See 37 C.F.R. §§2.6(a)(1)(i)-(iv), 2.209(a); TMEP §405.04.

 

When an application has abandoned for failure to respond to an Office action, an applicant may timely file a petition to revive the application, which, if granted, would allow the application to return to active status.  See 37 C.F.R. §2.66; TMEP §1714.  The petition must be filed within two months of the date of issuance of the notice of abandonment and may be filed online via the Trademark Electronic Application System (TEAS) with a $100 fee.  See 37 C.F.R. §§2.6(a)(15)(ii), 2.66(a)(1), (b)(1).
