Dear Attorney Tuvia Rotberg,

 

I have examined these applications and they require amendment before I can proceed, which I can correct from my end with your approval.  In particular, you must amend the identification of goods and add a disclaimer for both.

 

Identification

 

Some of wording you provided in the identification of goods for International Classes 7 and 9 must be clarified because it is indefinite or overbroad. Further, due to a potential 2(d) refusal related to pen lights in Class 11, if you do not limit these goods by specifying the medical purpose I will have to issue a 2(d) refusal in my first action.

 

Applicant may substitute the following wording, if accurate:

 

Class 5: Adhesive bandages; First aid kits; Gauze; Medical adhesive tape; Adhesive wound closure strips; Burn dressings

 

Class 10: Bandages, namely, elastic bandages, support bandages, self adherent cohesive elastic bandages, triangular elastic bandages, non-woven elastic bandages; Splints; Medical scissors; Medical ice packs; Chemically activated instant cold and hot packs for medical purposes; Medical gear bags designed to hold {indicate specific medical instruments}; Stethoscopes; Sphygmomanometers; Blood pressure cuffs; Backpacks for carrying medical equipment, namely, {indicate specific equipment}; Nebulizers for medical purposes; Otoscopes; CPR masks; CPR rescue mask training valves; CPR key chain masks; Respiratory equipment, namely, {indicate type, e.g., aspirators}; Oxygen regulators for medical use; Goniometers for orthopedic use; Thermometers for medical use; Pulse oximeters; Massage balls; Blankets for medical use; Emergency blankets for medical use; Emergency sleeping bags for medical use; Sharps containers, namely, containers for the disposal of {specify medical products, e.g., needles}; Compresses, namely, {indicate type, e.g, bandages}; Snake bite venom extractor kits; Oral irrigators; Diagnostic Penlights for medical purposes; Spinal boards; Stretchers; Oxygen Nasal Cannula clamps for securing medical tubing; Suction catheters; Bulb syringes for medical purposes; Medical exam gloves of nitrile; Medical exam gloves of vinyl; Medical apparatus, namely, {indicate type, e.g, bi-level positive} airway pressure devices; Orthopedic splints, namely, traction splints, board splints; Medical chairs for transporting patients; Containers for the disposal of medical supplies sold empty; Diagnostic tools, namely, percussion hammers, reflex hammers, pinwheels; Apparatus for vibrational therapy, namely, tuning forks; Forceps for medical use; Tweezers; Medical gowns; Surgical shoe covers; Medical devices for use in cannulation or to stem the flow of traumatic bleeding, namely, tourniquets; Medical staples

 

If you would like to add classes 8 (for “tweezers), 9 (for “oxygen regulators”) or 11 (for “diagnostic penlights”) please let me know and I will issue a Priority Action to assess the additional fee and issue the refusal.

 

Disclaimer

 

Applicant must disclaim the wording “FIRST AID” in EVER READY FIRST AID and “EMS” in DIXIE EMS because both terms merely describes a function of applicant’s services and thus are unregistrable components of the marks.

 

If the situation is otherwise, please explain in your reply. Please note that I will take official action on this claim by June 11, 2018 if I do not hear back from you by that date.
