Dear Commissioner:

 

            This paper is filed in response to the Refusal dated March 28, 2019, in which the Trademark Office refused registration under Trademark Act Section 2(d) by stating that the mark so resembles the marks shown in U.S. Registration No. 5566645 as to be likely to cause confusion, to cause mistake, or to deceive.  Applicant advises herewith that it and the owner of the cited Registration have agreed to terms set forth in a Consent Agreement.   Applicant intends to submit a fully executed Consent Agreement in due course.

CONCLUSION

Applicant submits that the issue raised in the Office Action has been addressed herewith.
