OFFICE ACTION
TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.
ISSUE/MAILING DATE: 6/10/2019
On 11/13/18, action on this application was suspended pending the disposition of U.S. Application Serial Nos. 79227558 and 79224017. The referenced prior-pending applications are withdrawn as potential cites under Section 2(d).
The following issues remain in the application:
AMENDMENT OF IDENTIFICATION OF GOODS REQUIRED
Upon further review of this application, applicant must indicate a particular type of monitor in order to allow for proper classification. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.
In addition, applicant must retain the limiting language utilized in the original application.
Applicant may amend the identification to clarify or limit the goods and/or services, but not to broaden or expand the goods and/or services beyond those in the original application or as acceptably amended. See 37 C.F.R. §2.71(a); TMEP §1402.06. Moreover, qualifying language may not be deleted from an identification. See TMEP §1402.06(a).
Therefore, the following amendment is suggested:
“Flat panel display screen monitor boom poles, none of the goods in relation to loudspeaker transducers used for sound reproduction,” in International Class 9.
