Application serial no. 87619318 APACHE(Standard Characters, see http://uspto.report/TM/87619318/mark.png) has been amended as follows:

EVIDENCE
Evidence has been attached: Statement in response to office action. Applicant thanks the Examiner for the phone conference this week and for reconsidering the specimen of use in view of the additional information provided. As you previously appreciated, the sale of the hydrocarbon products in class 4 are products where it is impracticable to place the mark on the goods so alternate forms of specimens of use are considered under 904.03k. The specimen of use provided is not for internal use nor an invitation to consider working with Apache. As discussed, the specimen of use is directed to the distribution of profits for the sale of hydrocarbon products for those already working with Apache. We reviewed in particular the second paragraph under the title of "Your unique owner number." The specimen of use is not a general invitation but is the form to establish remittance to actual clients. We appreciate your review of the specimen and for allowing us to point out that this is a specimen of use that is used with actual clients and is directly related to the sale of hydrocarbon products. Acceptance of the specimen of use for class 4 is respectfully requested.
