TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.

The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
SEARCH OF OFFICE’S DATABASE OF MARKS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
SECTION 2(e)(1) REFUSAL - MERELY DESCRIPTIVE
In this case, applicant’s mark combines two descriptive words to create a merely descriptive mark.
Only where the combination of descriptive terms creates a unitary mark with a unique, incongruous, or otherwise nondescriptive meaning in relation to the goods and/or services is the combined mark registrable. See In re Colonial Stores, Inc., 394 F.2d 549, 551, 157 USPQ 382, 384 (C.C.P.A. 1968); In re Positec Grp. Ltd., 108 USPQ2d 1161, 1162-63 (TTAB 2013).
In this case, both the individual components and the composite result are descriptive of applicant’s goods and/or services and do not create a unique, incongruous, or nondescriptive meaning in relation to the goods and/or services. Specifically, applicant’s mark combines the word to describe applicant’s consumers and subject matter with a term that identifies the means of the delivering the services. As such, the mark describes a feature and characteristic of the services.
The attached evidence shows that the individual terms have descriptive meanings in relation to the goods and/or services, and that the combined terms retain the descriptive meaning:
1. UMMAA – a variation of the spelling of UMMAH, which means “the Islamic community” (http://www.dictionary.com/browse/ummah) or to refer to “the diaspora or “Community of the Believers” (ummat al-mu'minin), and thus the whole Muslim world.” (http://islamic-dictionary.tumblr.com/post/4353858659/ummah-arabic-%D8%A3%D9%85%D8%A9-is-an-arabic-word-meaning). This word is commonly used to refer to a group of people:

2. BROADCASTING: defined as the act of transmitting speech, music, visualimages, etc., as by radio or television (http://www.dictionary.com/browse/broadcasting?s=t) and used to describe the means by which applicant’s services are delivered, distributed over television, satellite, film, audio, video, internet, and 3-D virtual reality media.
a. http://www.psacentral.org/campaign/Project_roadblock?irid=HomeButton|PRB – public service programs broadcast on television;
b. http://mediatracks.com/services/public-service-announcements-psas/ - public service announcements are broadcast to the public;
c. http://ccmc.org/tips/public-service-announcements/ - public service programs distributed via broadcasting.
Here, as shown by the attached evidence, applicant’s services feature subject matter and topics relevant to the Muslim community or dealing with current events and issues in the Muslim community. http://www.ourbeacon.com/cgi-bin/bbs60x/webbbs_config.pl/md/read/id/314123119246180; http://shiastrength.blogspot.com/2010/02/mahdiunitemuslims-stop-deportation-of.html. Therefore, the wording “UMMAA,” as a variation of UMMAH, would identify applicant’s consumers and subject matter, while BROADCASTING identifies how the services are rendered.
Therefore, applicant’s mark UMMAA BROADCASTING is merely descriptive of applicant’s services, and is refused registration under Section 2(e)(1) of the Trademark Act.
Although applicant’s mark has been refused registration, applicant may respond to the refusal(s) by submitting evidence and arguments in support of registration. If applicant responds to the refusal(s), applicant must also respond to the requirement(s) set forth below.
Examples of specimens for goods include tags, labels, instruction manuals, containers, photographs that show the mark on the actual goods or packaging, and displays associated with the actual goods at their point of sale. See TMEP §§904.03 et seq. Webpages may also be specimens for goods when they include a picture or textual description of the goods associated with the mark and the means to order the goods. TMEP §904.03(i). Examples of specimens for services include advertising and marketing materials, brochures, photographs of business signage and billboards, and webpages that show the mark used in the actual sale, rendering, or advertising of the services. See TMEP §1301.04(a), (h)(iv)(C). Specimens comprising advertising and promotional materials must show a direct association between the mark and the services. TMEP §1301.04(f)(ii).
Applicant may respond to this refusal by satisfying one of the following for each applicable international class:
(1) Submit a verified specimen that (a) was in actual use in commerce at least as early as the filing date of the application and (b) shows the mark in actual use in commerce for the goods and/or services identified in the application. A “verified specimen” is a specimen that is accompanied by the following statement made in a signed affidavit or supported by a declaration under 37 C.F.R. §2.20: “The substitute (or new, or originally submitted, if appropriate) specimen(s) was/were in use in commerce at least as early as the filing date of the application.” The specimen cannot be accepted without this statement.
(2) Amend the filing basis to intent to use under Section 1(b), for which no specimen is required. This option will later necessitate additional fee(s) and filing requirements such as providing a specimen.

INFORMATION ABOUT THE SERVICES REQUIRED
(1) Fact sheets, instruction manuals, brochures, advertisements and pertinent screenshots of applicant’s website as it relates to the goods and/or services in the application, including any materials using the terms in the applied-for mark. Merely stating that information about the goods and/or services is available on applicant’s website is insufficient to make the information of record.;
(2) If these materials are unavailable, applicant should submit similar documentation for goods and services of the same type, explaining how its own product or services will differ. If the goods and/or services feature new technology and information regarding competing goods and/or services is not available, applicant must provide a detailed factual description of the goods and/or services. Factual information about the goods must make clear how they operate, salient features, and prospective customers and channels of trade. For services, the factual information must make clear what the services are and how they are rendered, salient features, and prospective customers and channels of trade. Conclusory statements will not satisfy this requirement.; and
(3) Applicant must respond to the following questions: Are applicant’s services directed towards Muslim consumers? Will applicant’s service be broadcast? Do applicant’s competitors use UMMAA, UMMAH, or other variations of the spelling of UMMAH to advertise similar services? Who is the typical consumer of applicant’s services?.

Failure to comply with a request for information is grounds for refusing registration. In re Harley, 119 USPQ2d 1755, 1757-58 (TTAB 2016); TMEP §814.
SUPPLEMENTAL REGISTER AND DISCLAIMER ADVISORY
The applied-for mark has been refused registration on the Principal Register. Applicant may respond to the refusal by submitting evidence and arguments in support of registration and/or by amending the application to seek registration on the Supplemental Register. See 15 U.S.C. §1091; 37 C.F.R. §§2.47, 2.75(a); TMEP §§801.02(b), 816. Amending to the Supplemental Register does not preclude applicant from submitting evidence and arguments against the refusal(s). TMEP §816.04. In addition, to be approved for registration on the Supplemental Register, applicant must submit an acceptable specimen.
The following is the standardized format for a disclaimer:
No claim is made to the exclusive right to use “BROADCASTING” apart from the mark as shown.
TMEP §1213.08(a)(i).
1. Indefinite and/or Overbroad Wording
The wording “in the field of media” in the identification of services is indefinite and must be clarified because as written, the identification is circular in that it identifies public services programs in media broadcast through media. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. Applicant may substitute “in the field of media” with a more definite field, for example, promoting social and political issues relevant to Muslims, etc.
If applicant adopts the suggested amendment of the identification of goods and/or services, then applicant must retain the classification in International Class 41. See 37 C.F.R. §§2.32(a)(7), 2.85; TMEP §§805, 1401.
2. Proposed Amendments
Applicant may substitute the following wording, if accurate:
International Class 41:
Continuing public service programs in the field of political and social issues relevant to Muslims {or specify other accurate subject matter or field} produced and distributed
over television, satellite, film, audio, video, internet, and 3-D virtual reality media
3. Scope Advisory
Applicant may amend the identification to clarify or limit the goods and/or services, but not to broaden or expand the goods and/or services beyond those in the original application or as acceptably amended. See 37 C.F.R. §2.71(a); TMEP §1402.06. Generally, any deleted goods and/or services may not later be reinserted. See TMEP §1402.07(e).

In addition, because applicant filed a TEAS RF application, applicant must respond online using the Trademark Electronic Application System (TEAS) to avoid incurring an additional fee. See 37 C.F.R. §2.23(b)(1), (c). If applicant does not respond to this Office action within six months of the issue/mailing date, or responds by expressly abandoning the application, the application process will end and the trademark will fail to register. See 15 U.S.C. §1062(b); 37 C.F.R. §§2.65(a), 2.68(a); TMEP §§718.01, 718.02. Additionally, the USPTO will not refund the application filing fee, which is a required processing fee. See 37 C.F.R. §§2.6(a)(1)(i)-(iv), 2.209(a); TMEP §405.04.
When an application has been abandoned for failure to respond to an Office action, an applicant may timely file a petition to revive the application, which, if granted, would allow the application to return to active status. See 37 C.F.R. §2.66; TMEP §1714. The petition must be filed within two months of the date of issuance of the notice of abandonment and may be filed online via TEAS with a $100 fee. See 37 C.F.R. §§2.6(a)(15)(ii), 2.66(a)(1), (b)(1).
For attorney referral information, applicant may consult the American Bar Association’s Consumers’ Guide to Legal Help; an online directory of legal professionals, such as FindLaw®; or a local telephone directory. The USPTO, however, may not assist an applicant in the selection of a private attorney. 37 C.F.R. §2.11.
TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820. TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services. 37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04. However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.
