DATABASE SEARCH:  The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

ISSUES APPLICANT MUST ADDRESS:  On November 16-21, 2017, the trademark examining attorney and PATRICK J. JENNINGS discussed the issues below.  Applicant must timely respond to these issues.  See 15 U.S.C. §1062(b); 37 C.F.R. §2.62(a); TMEP §§708, 711.

 

SUMMARY OF ISSUES:

  • Requirement for an Acceptable Identification of Goods
  • Requirement for Multiple Class Applications

IDENTIFICATION AND CLASSIFICATION OF GOODS

 

The identification of goods is indefinite and must be clarified because the wording is broad and could include goods in more than one International Class.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. 

 

For example, the wording “products” is indefinite and some of the wording could encompass goods in other classes. See TMEP §§1402.01, 1402.03. For example, “products destroying vermin” encompasses “mousetraps” which are in Class 021 while “implants consisting of artificial materials” are in Class 010.

 

Further, particular wording in the U.S. application’s identification of goods has been found to exceed the scope of goods in the foreign registration upon which the U.S. application relies.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.06 et seq., 1402.07.  For a U.S. application based on Section 44(e), an applicant is required to list only goods that are within the scope of the goods in the foreign registration.  37 C.F.R. §2.32(a)(6); TMEP §§1012, 1402.01(b).  Therefore, this wording is not considered part of the identification of goods in the U.S. application, and only the remaining wording in the identification is operative for purposes of future amendment.  See TMEP §1402.01(b); cf. TMEP §1402.07(d).

 

In this case, the U.S. application identifies the particular goods as follows:  “sanitary preparations” and “products for destroying vermin”. 

 

However, the foreign registration identifies the following goods:  “Pharmaceutical and veterinary preparations, as well as health care preparations for medical purposes; dietetic substances adapted for medical use, food for babies; plasters; materials for dressings; material for stopping teeth, dental wax; disinfectants; preparations for destroying vermin; fungicides, herbicides.”

 

These goods in the U.S. application exceed the scope of the goods in the foreign registration because “sanitary preparations” is not identified alone and “products for destroying vermin” is broader in scope than “preparations for destroying vermin”.  Thus, these goods in the U.S. application are not acceptable.

 

Applicant may respond to this issue by satisfying one of the following:

 

(1)       Amending the identification of goods in the U.S. application to correspond to the goods in the foreign registration, if possible, to ensure that all goods beyond the scope of the foreign registration are deleted from the U.S. application or amended to be within the scope of the foreign registration; or

 

(2)       Substituting a basis under Section 1(a) or 1(b) for those goods in the U.S. application that are beyond the scope of the foreign registration.  An applicant may assert more than one basis in an application (except Section 1(a) and 1(b) may not be asserted for the same goods), provided all requirements are satisfied for each claimed basis.

 

See 15 U.S.C. §§1051(a)-(b), 1126; 37 C.F.R. §§2.32(a)(6), 2.34(b), 2.35(b); Marmark Ltd. v. Nutrexpa S.A., 12 USPQ2d 1843, 1845 (TTAB 1989); TMEP §§806.02, 806.03(h), 1402.01(b). 

 

Additionally, applicant may respond by arguing that these goods are within the scope of the foreign registration and should remain in the U.S. application or amending them as suggested below.

 

Applicant may substitute the following wording, if accurate:

 

“Pharmaceutical and veterinary preparations for the treatment of skin defects; pharmaceutical and veterinary products for the treatment of skin defects in the form of medical dressings, in the form of skin implants comprising living tissue featuring primarily reconstructed collagen, and in the form of skin implants comprising living tissue; health care preparations for medical purposes, namely, sanitary sterilizing preparations for medical purposes; dietetic foods and drinks adapted for medical use, food for babies; medical plasters; materials for dressings, namely, gauze, cotton balls, bandages; material for stopping teeth and dental wax; all-purpose disinfectants; preparations for destroying vermin; fungicides, herbicides” in International Class 005; and/or

 

“Pharmaceutical and veterinary products for the treatment of skin defects in the form of skin implants consisting of artificial materials” in International Class 010; and/or

 

“Products for destroying vermin, namely, mousetraps” in International Class 021

 

SCOPE ADVISORY: Applicant may amend the identification to clarify or limit the goods, but not to broaden or expand the goods beyond those in the original application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Generally, any deleted goods may not later be reinserted.  See TMEP §1402.07(e).

 

DESCRIPTION ADVISORY: Identifications of goods are examined in accordance with the Trademark Rules of Practice and the USPTO’s policies and procedures in effect on the date an application is filed (although an applicant may voluntarily choose to follow policies and procedures adopted after the application was filed).  See 37 C.F.R. §2.85(e)(1)-(e)(2); TMEP §§1401.09, 1402.14.  The USPTO’s rules and policies with respect to identifications of goods are updated periodically to reflect changes in the marketplace and technology as well as changes to the international classification system.  See TMEP §1402.14.  For guidance on drafting acceptable identifications of goods, use the USPTO’s online U.S. Acceptable Identification of Goods and Services Manual (ID Manual), which is continually updated in accordance with prevailing rules and policies.  See TMEP §1402.04.

 

MULTIPLE-CLASS APPLICATION REQUIREMENTS

 

The application identifies goods in more than one international class; therefore, applicant must satisfy all the requirements below for each international class based on Trademark Act Section 44:

 

(1)       List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.

 

(2)       Submit a filing fee for each international class not covered by the fee already paid (view the USPTO’s current fee schedule).  The application identifies goods and/or services that are classified in at least three classes; however, applicant submitted a fee sufficient for only one class.  Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.
