I am a trademark examining attorney for the U.S. Patent and Trademark Office. I am contacting you because I have examined the application for PREVIDENT (U.S. Application Serial No. 87436601) and found an issue that can be resolved quickly and informally (through email or by phone) with an Examiner’s Amendment.
Specifically, the identification of goods includes indefinite wording that must be clarified. Applicant’s identification of goods is as follows: “Medicated oral rinse,” in International Class 5. The identification of goods is indefinite and must be clarified because applicant must specify the nature of the goods intended by this wording.
Applicant may substitute the following wording, if accurate. Suggested wording is in bold: “Medicated oral rinse, namely, ____ {specify, e.g., medicated anti-cavity dental rinses, medicated anti-cavity mouth rinses, medicated dental rinses},” in International Class 5.
Please get back to me no later than 4:00 pm (eastern standard time) on August 7 with your proposed amended identification. If it is acceptable, I will be happy to enter it into the record by Examiner’s Amendment. This should resolve all issues in the application. If you need more time to respond, please let me know and I will issue a Priority action, which will give the applicant six months to file a formal response.
