The registrant requests the following amendment(s) to registration no. 5516629 HEY DUDE(Standard Characters, see http://uspto.report/TM/87371164/mark.png) has been amended as follows:

EXPLANATION OF FILING
Registrant requests correction of a mistake in the registration under ?7(h) of the Trademark Act, 15 U.S.C. ?1057(h). The mistake in the registration occurred in good faith through the fault of the owner of the registration, or its attorney. When the original application was filed, the registrant?s attorney, located in Italy, inadvertently indicated that the registrant, Full Fortune Brands Limited was a corporation of Italy, and not, as was true at the time and remains true today, that registrant is a Hong Kong private company limited by shares (the equivalent of a corporation, but organized in Hong Kong). There was no such entity as ?Full Fortune Brands Limited? a corporation of Italy at the time that the application in this case was filed on March 14, 2017. The applicant at the time and registrant now was and is Full Fortune Brands Limited, a Hong Kong private company limited by shares. Registrant submits with this petition an extract obtained on May 7, 2020 from ICRIS, the database of CSC Companies Registry, the Government of Hong Kong Special Administrative Region, indicating that Full Fortune Brands Limited is an active or ?live? private company limited by shares incorporated in Hong Kong on April 22, 2013. Registrant submits that the mistake in this case is minor, does not affect the validity of the registration, and is appropriate for correction under both TMEP ?1609.10(b) and ?1201.02(c). It is a correctable error much like the first three examples set forth in ?1201.02(c), namely: (1) Trade Name Set Forth as Applicant. If the applicant identifies itself by a name under which it does business, which is not a legal entity, then amendment to state the applicant?s correct legal name is permitted. Cf. In re Atl. Blue Print Co., 19 USPQ2d 1078 (Comm'r Pats 1990) (finding that Post Registration staff erred in refusing to allow amendment of affidavit under 15 U.S.C. ?1058 to show registrant?s corporate name rather than registrant?s trade name). 2) Operating Division Identified as Applicant. If the applicant mistakenly names an operating division, which by definition is not a legal entity, as the owner, then the applicant?s name may be amended. See TMEP ?1201.02(d). (3) Minor Clerical Error. Minor clerical errors such as the mistaken addition or omission of "The" or "Inc." in the applicant?s name may be corrected by amendment, as long as this does not result in a change of entity. Registrant?s requested correction in this case is not as the registrant entity ? which remains one and the same legal entity as the entity that filed the original application and was granted the registration. Please amend the USPTO record and the certificate of registration to indicate that registrant Full Fortune Brands Limited is a Hong Kong private company limited shares.
