Thank you for your message requesting confirmation of certain arguments made during our February 7, 2018 telephone interview for addition to the record in this matter.
To clarify, the channels of trade, field of use and class of consumers for Applicant’s mark are distinct from those for the cited registration. Applicant’s use of the mark is directed to the control, monitoring and regulation of specific welding processes that take place in specific welding machines. Those purchasing and operating such goods are typically highly skilled welding supervisors and technicians that are trained to weld precision, often miniaturized, components. The cited registration is directed to computer hardware and software for industrial process control. Industrial process control is a generalized term for achieving a production level of consistency, economy and safety in a factory environment, for example. A person that is tasked to purchase or carry out precision welding operations typically would not be the same person as one tasked to purchase for and oversee economy and safety in a factory. As such, Applicant submits that there is no likelihood of confusion between the applied for mark and the mark that is the subject of the cited registration..
