ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

The Examining Attorney has cited a prior-pending application owned by Jaguar Land Rover Limited for the mark DISCOVERY, Application Serial No. 79/177962. Each party believes that the coexistence of their marks in the marketplace is not likely to create confusion. The parties have entered into an Agreement accordingly; a copy of a Letter of Consent executed in furtherance of the Agreement is attached as Exhibit A. Applicant believes that it has satisfactorily addressed the issues raised by the Examining Attorney in the Office Action. Therefore, Applicant respectfully requests that the Examining Attorney approve Applicant's Mark for publication.
