To the Commissioner for Trademarks:

The following is submitted for application serial number. 86321871

FORM INFORMATION

PETITION TO AMEND THE FILING BASIS UNDER 37 C.F.R. § 2.146(a)(2)

Applicant hereby respectfully requests that, pursuant to 37 C.F.R. §2.35(b)(2); (TMEP §806.03(j)), the filing basis in International Class 44 of the above referenced application be amended to §44(e), based on the Colombian Registration No. 335000. The claim based on §44(e) applies to all of the services currently covered by the §1(b) basis in International Classes 44.

A Notice of Allowance has already been issued; therefore, Applicant respectfully requests that the filing basis of the §1(b) “Intent to Use” be deleted from Class 44.

In the event that the Examining Attorney does not accept the substitute §44(e) basis, either in its entirety or for only a partial list of the services, Applicant respectfully requests that the §1(b) be maintained on the services for which the §44(e) basis is rejected.

The Colombian Registration No. 335000 was granted on July 06, 2007 and has an expiration date of July 06, 2027. Please find attached herewith a true copy of a certification issued by the Colombian Trademark Office along with its English translation.

Applicant believes that this application is now in order for acceptance under §44(e) in connection with all services currently covered in International Class 44, and requests that such favorable consideration be made.

Payment in the amount of $100.00 is being submitted herewith with this Petition.
