THIS IS A FINAL ACTION.

 

 

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE:  Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.  See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820.  TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $50 per international class of goods and/or services.  37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.  However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone without incurring this additional fee. 

 

 

INTRODUCTION

 

This Office action is in response to applicant’s communication filed on December 2, 2015.

 

In a previous Office action(s) dated June 2, 2015, the applicant was required to satisfy the requirement to amend the identifications of goods and services in International Classes 7, 9, 11, 17, 19, 21, 41 and 42. 

 

Based on applicant’s response, the trademark examining attorney notes that requirement for providing definite identifications in International Classes 17 and 19 has been satisfied.    See TMEP §§713.02, 714.04.   Additionally, the amended identification of services in International Class 35 is accepted.

 

Further, the trademark examining attorney maintains and now makes FINAL the requirement(s) in the summary of issues below.  See 37 C.F.R. §2.63(b); TMEP §714.04.

 

SUMMARY OF ISSUES MADE FINAL that applicant must address:

  • Identification of goods requirement – International Class 7
  • Identification of goods requirement – International Class 9
  • Identification of goods requirement –International Class 11
  • Identification of goods requirement – International Class 21
  • Identification of services requirement – International Class 41
  • Identification of services requirement – International Class 42

 

Identification Of Goods – International Class 7

The wording “hydraulically operated remote control valves” in the identification of goods must be clarified because it is too broad and could include goods in other international classes.  See TMEP §§1402.01, 1402.03.  While valves for pumps are classified in International Class 7, valves for other purposes are classified in other classes.  For example, direction control valves for use in automated production machinery are classified in International Class 9.  Additionally, hose reels are generally classified based upon their composition, and since the applicant’s original identification was limited to power-operated hose reels, the identification may not be amended to include spring-retracted hose reels, which are generally not power-operated.

 

Identification Of Goods – International Class 9

The identification of goods is indefinite and must be clarified.  See TMEP §1402.01.  While terms such “automatic controls for irrigation systems” may be considered a common commercial term in the industry, the United States Patent and Trademark Office requires specificity with regard to identifications.  Automatic controls  could include a variety of goods that fall under the aegis of this wording, and the identification must be specific, definite and concise. 

 

Additionally, the identification of goods in International Class 9 includes a duplicate entry of the wording “timers.”  Applicant may either (1) modify one of these two identical descriptions of goods and/or services such that it will no longer be duplicative, or (2) delete one entry.  See TMEP §707.02.  However, if applicant modifies the goods and/or services, applicant may do so only to clarify or limit them; adding to or broadening the scope of the goods and/or services is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07. 

 

 

 

Identification Of Goods – International Class 11

The identification of goods must be clarified because it is too broad and could include goods in other international classes.  See TMEP §§1402.01, 1402.03.  Hydraulic and pneumatic valve actuators are classified in International Class 7, while electric valve actuators are classified in International Class 9.  The applicant must specify the particular type of actuators utilized in irrigation systems, and properly classify the goods.  The applicant must also identify each product using common commercial terms.  While an “irrigation bubbler” may be a term of art in the industry, it could include a variety of goods and the identification must be specific, definite and concise.

 

Identification Of Goods – International Class 21

The identification of goods must be clarified because it is too broad and could include goods in other international classes.  See TMEP §§1402.01, 1402.03.  Water sprinklers could include fire sprinklers in International Class 9, irrigation sprinklers in International Class 11, and lawn sprinklers in International Class 21.  Similarly, sprinkler systems for fire protection are classified in International Class 9, while sprinkler systems for lawns are classified in International Class 11 if they comprise pumps, valves and filters.  The identification must be specific, definite and concise.

 

 Identification Of Services – International Class 41

The identification of services must be clarified because it is too broad and could include services in other international classes.  See TMEP §§1402.01, 1402.03.  Information services are presumably provided for educational purposes.  Unless the information services are specifically identified as a type of educational services such as classes of instruction, the services are classified based upon subject matter.  Merely indicating that information is provided for educational purposes does not justify classification of the services in International Class 41, as all information services presumably education consumers. 

 

Identification Of Services – International Class 42

The identification of services must be clarified because it is too broad and could include services in other international classes.  See TMEP §§1402.01, 1402.03.     For example, technical consulting services could include a wide variety of services in more than one international class.  Similarly, design services could include a variety of services and the identification must be specific, definite and concise.

 

Suggested Identifications Of Goods And Services

Applicant may substitute the following wording, if accurate:

Additions To Identification Not Permitted
