Dear Ryan,
Further to our call yesterday, depending how the identification is amended, the goods could be classified in multiple classes. I understand that the application is ITU, but here are some suggestions, based on the information that you have provided:
Class 9: Electronic storage containers, in the nature of electronic safes, featuring electronically activated locks for commercial, industrial and domestic use.
(Because the function of the goods are that of an electronic safe the goods will be classified in Class 9).
Class 6: Metal storage containers featuring electronically activated locks for commercial, industrial and domestic use. (This is a metal storage container in Class 6).
Class 20: Plastic storage containers for commercial or industrial use, featuring electronically activated locks.
Class 21: Plastic storage containers for household or domestic use, featuring electronically activated locks.
If the applicant decides to add any classes to the application this must be done via our TEAS response system and the applicant must pay the filing fees for the additional classes. If the applicant adopts the proposed suggestion in Class 009, this can be done via an Examiner’s Amendment.
I look forward to hearing from you shortly. I will issue a final ID requirement early next week if we are unable to resolve via an EA.
