The Voluntary Amendment submitted on April 4, 2017 is refused for the following reasons:
The Voluntary Amendment lacks sufficient information to determine the nature of the request and/or has failed to meet the statutory requirements under Section 7 TMEP 1609. It appears the submission is improper and submitted using an incorrect form. Once the Trademark application has registered, a Voluntary Amendment is used only to supplement or modify information already submitted through a Post-Registration filing and prior to the Post-Registration Specialist conducting an examination. For example, if you have not already made a Post-Registration filing, such as a Section 8, and you are merely trying to amend or correct a registration certificate, the Preliminary/Voluntary Amendment form should not be used.
If you are requesting a Corrected Registration Certificate, an Amended Registration Certificate or a New Registration Certificate, a proper request under Section 7 must be submitted. The Section 7 Request form is located at http://www.gov.uspto.report/trademarks/teas/reg_maintain.jsp, number 5 - Section 7 Request for Amendment or Correction of Registration Certificate.
