Dear Mr. Slattery:
This acknowledges receipt on June 29, 2016, of a petition to the Director to permit the examining attorney to consider an amendment to the identification goods and services for the above identified application.
DECISION: The petition is hereby DISMISSED as MOOT.
A petition to the Director is required to waive Trademark Rule 2.77 to allow an amendment during the period between the issuance of the notice of allowance and the filing of a statement of use. 37 C.F.R. §2.77. A review of the application shows that the notice of allowance has not yet issued. Therefore, no petition is needed and the petition is dismissed as moot.
The $100 petition fee, received on June 29, 2016, will be refunded. The amendment to the identification of goods and services in classes 9 and 42 have been entered and the application will be forwarded for issuance of the Notice of Allowance.
