This Suspension Notice is issued following the Office action dated July 25, 2014 and the Examining Attorney’s conversation with Aaron Fennimore on August 19, 2014.
The Section 2(d) refusals based on U.S. Registration Nos. 3782410 and 4479555 are withdrawn. The citations to prior pending application Serial Nos. 79144411, 79146471, 85712400, 85757016, 85815707, 85815719, 85815804, 85818293, 85866004, 86021021, 86177763, 86228923 and 86236757 are withdrawn.
The trademark examining attorney is suspending action on the application for the reason stated below. See 37 C.F.R. §2.67; TMEP §§716 et seq.
The effective filing dates of the pending applications identified below precede the filing date of applicant’s application. If a mark in the referenced applications registers, applicant’s mark may be refused registration under Section 2(d) because of a likelihood of confusion with the registered mark(s). See 15 U.S.C. §1052(d); 37 C.F.R. §2.83; TMEP §§1208 et seq. Therefore, action on this application is suspended until the earlier-filed referenced applications are either registered or abandoned. 37 C.F.R. §2.83(c). Copies of information relevant to the referenced applications were sent previously.

The USPTO will periodically conduct a status check of the application to determine whether suspension remains appropriate, and the trademark examining attorney will issue as needed an inquiry letter to applicant regarding the status of the matter on which suspension is based.
