DATABASE SEARCH: The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
ISSUES APPLICANT MUST ADDRESS: On January 30, 2015, the trademark examining attorney and Merritt R. Blakeslee discussed the issues below. Applicant must timely respond to these issues. See 15 U.S.C. §1062(b); 37 C.F.R. §2.62(a); TMEP §§708, 711.
Additional Fee Required:
The application identifies goods that are classified in four classes; however, applicant submitted fees sufficient for only three classes. In a multiple-class application, a fee for each class is required. 37 C.F.R. §2.86(a)(2); TMEP §§810.01, 1403.01.
Therefore, applicant must either (1) restrict the application to the number of classes covered by the fees already paid, or (2) submit the fees for each additional class.
APPLICATION HAS BEEN AMENDED: In accordance with the authorization granted by the individual identified in the Priority Action section above, the trademark examining attorney has amended the application as indicated below. Please advise the undersigned immediately of any objections. TMEP §707. Any amendments to the identification of goods and/or services may clarify or limit the goods and/or services, but may not add to or broaden the scope of the goods and/or services. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.
(1) Identification Of International Class 6 Goods:
The identification of International Class 6 goods is amended to read as follows:
“aftermarket automobile accessories, namely, kits comprised of metal washers for fenders, novelty metal miniature license plates, and slope boxes, namely, metal ramps for use with automobiles.”
See TMEP §§1402.01, 1402.01(e).
(2) Please also note the following:
* The identifications of International Class 7, 12 and 27 goods are acceptable as currently worded.
* The substitute specimens of use are accepted and entered into the record.
* The references to the prior pending applications as potential bars to registration are withdrawn.
* The claim of ownership of the applicant’s prior registration is accepted and entered into the record.
