DATABASE SEARCH: The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
APPLICATION HAS BEEN AMENDED: In accordance with the authorization granted by P. PAYTON KASHANI on March 5, 2014, the trademark examining attorney has amended the application as indicated below. Please advise the undersigned immediately of any objections. Otherwise, no response is necessary. TMEP §707. Any amendments to the identification of goods may clarify or limit the goods, but may not add to or broaden the scope of the goods. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.
The identification of goods is amended and restricted to read as follows:
“Analgesic and muscle relaxant pharmaceutical preparations; Balms for pharmaceutical purposes; Chemical preparations for pharmaceutical or medical purposes, namely, for reduction of pain and inflammation; Gels, creams and solutions for dermatological use; Herbal topical creams, gels, salves, sprays, powder, balms, liniment and ointments for the relief of aches and pain; Homeopathic pharmaceuticals for use in the treatment of pain and inflammation; Menthol for pharmaceutical purposes; Pharmaceutical preparations for the treatment and prevention of pain and inflammation; Pharmaceutical preparations for treating and preventing tendon and muscle injuries and disorders, sports related injuries, and for knee cartilage regeneration; Pharmaceutical preparations for reduction of pain and inflammation; Preparation for the relief of pain,” in International Class 05.

MARK DESCRIPTION
The following description of the mark is added to the record:
The mark consists of the term “TEROCIN” in stylized green font. Above the letter “I” is a single green leaf blowing north east at roughly a 45 degree angle. Within the leaf there is a single white line in the middle of the leaf following the same direction of the leaf. Just within the borders of the leaf there are thin light green lines.
